RESOLUTION TO APPROVE CHANGE ORDER NO. 5 FROM
ItATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD
STREET RECONSTRUCTION, TRAIL,AND DRAINAGE IMPROVEMENTS
PROJECT IN THE CITY OF FAIRFAX,LINN COUNTY,IOWA
WHEREAS, the City Council of Fairfax, Iowa has contracted with Rathje
Construction Co. for the Phase 2 East Cemetery Road Street Reconstruction, Trial, and
Drainage Improvements Project within the corporate limits; and
WHEREAS, the City of Fairfax, on October 14, 2014, previously approved
Change Order. ##5 from Rathje Construction, Co., but they refused to sign and accept
Change Order 45 as previously worded, making the original Change Order #5 invalid;
and
WHEREAS, the City of Fairfax shall pay the costs of this change order to the
extent of the original contract unit price (Bid Item No. 62 , which is $241.$$; and Hall
and Hall Engineers, Inc. shall pay for the costs of this change order above the original
cost of the contract unit price(Bid Item No. 62), which is $2,203,12; and
WHEREAS, Hall and Hall Engineers, Inc., has recommended approval of this
new Change Order#5 as described below:
CHANGES IN CONTRACT AMOUNT:
ITEM #5: Widen P.C.C.. driveway at 29 E. Cemetery Rd, 5" P.C.C. on 4" Granular
Sub-base
Widen the P.C.C. driveway at 29 E. Cemetery Road so that the driveway is
approximately 22p wide at the street. Lump sum fee of$2,445.00 to complete the
driveway widening.

CHANGES IN CONTRACT AMOUNT: an additional $2,445.00.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, to approve Change Order No. 5 from Rathje Construction Co. for the
Phase 2 East Cemetery Read Street Reconstruction, Trial, and Drainage Improvements
Project for an additional$2,445.00 making the contract amount$971,087.$$.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.
