A RESOLUTION TO SUBMIT TO THE VOTERS OF THE CITY OF
FAIRFAX THE QUESTION OF ALTERING THE NUMBER OF LIBRARY
TRUSTEES AND THE RESIDENCY REQUIREMENTS OF THE
LIBRARY TRUSTEES
WHEREAS, the Board of Trustees of the Fairfax Public Library has submitted to the
City Council of the City of Fairfax, Iowa, a proposal to alter the number of Library Trustees and
the residency regluirements of the Library Trustees; and
WHEREAS, the proposal must be submitted to the voters at the next regular City
election; and
WHEREAS, the City Council has reviewed the proposal and is in agreement with the
same.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Fairfax, Iowa, that:
1. The following questions shall, be submitted to the voters of the City of Fairfax at
the next municipal election, on November 3, 2015,
SHALL CHAPTER 21, LIBRARY BOARD OF TRUS'T'EES, SECTIONS 21.02,
21.03, AND 21.04 OF THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX,IOWA,BE AMENDED AS FOLLOWS:
21.02 LIBRARY TRUSTEES. The Board of Trustees of the Library, hereinafter
referred to as the Board, consists of five (5) resident members, one (1) nonresident
member, and one (1) at large member. All resident members are to be appointed by the
Mayor with the approval of the Council. All nonresident members are to be appointed by
the Mayor with the approval of the Linn County Board of Supervisors.
21.03 QUALIFICATIONS OF T11`USTEES. All resident members of the :board shall
be bona fide citizens and residents of the City of Fairfax, Iowa. The nonresidential
member of the Board shall be a bona fide citizen and resident of unincorporated Linn.
County, Iowa. The at large member of the Board shall be a bona fide citizen of either the
City of Fairfax, Iowa, or of unincorporated Linn County, Iowa. Members shall be the age
of eighteen(18) years or older.
21.04 ORGANIZATION OF THE BOARD. The organization of the Board shall be as
follows:
1. Tetra of Office. All appointments to the Board shall be for six (o) years,
except to fill vacancies. Each term shall commence on .Ealy first. Appointments shill be
made every two (2) years of one-third (113) the total, number of the Board or as near as
possible, to stagger the terms. There shall be a limit of two consecutive tenns, with a
minimum of one year absence from. the 'Board before being eligible to be appointed
again.
2. Vacancies. The position of any resident Trustee shall be vacated if such
member moves from the City of Fairfax, Iowa. The position of a nonresident Trustee
shall be vacated if such member moves from the unincorporated areas of Linn County.
The position of any Trustee shall be deemed vacated if such member is absent from six
(6) consecutive regular meetings of the Board, except in the case of illness or temporary
absence. Vacancies in the Board shall be filled in the same manner as an original
appointment except that the new Trustee shall fill out the unexpired terra for which the
appointment is made.
3. Compensation. 'Trustees shall receive no compensation for their services..
BE IT FURTHER RESOLVE,D, by the Fairfax City Council of the City of Fairfax.,
Iowa, that the City Clerk shall forward a certified copy of this Resolution to the Linn County
Auditor immediately so that the same can be placed on the municipal ballot for November 3,
20 15, and the Mayor and City Clerk are hereby directed to certify this resolution of approval.
