RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC
HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND
ORAL COMMENTS ON VACATING A PUBLIC ACCESS
EASEMENT, A PRIVATE ACCESS EASEMENT, AND A SANITARY
SEWER EASEMENT
WHEREAS, the City of Fairfax has received a request to consider the Final Plat
of Sobaski's Second Addition in the City of Fairfax, Linn County, Iowa, a Replat of Lots
1, 2, and Outlot A of Sobaski's Addition in the City of Fairfax, Linn County, Iowa all
within the City of Fairfax, Iowa; and
WHEREAS,as part of this process Sobaski Real Estate, L.L.C.have requested that
the City of Fairfax vacate the existing 30 foot private access easement,the existing 60 foot
public access easement, and the existing 20' sanitary sewer easement, all located on part
of Lots 1, 2 and Outlot A of Sobaski's Addition in the City of Fairfax, Linn County, Iowa;
and
WHEREAS, Iowa Code requires a public hearing concerning vacation of these
easements; and
WHEREAS, interested residents or taxpayers having comments for or against the
proposed private access, public access, and sanitary sewer easement vacations may appear
and be heard at the public hearing at the city council meeting on February 9, 2016, at 7:00
PM at the Fairfax City Hall, at 525 Vanderbilt Street, Fairfax, Iowa.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, that this confirms that the city council order the publication of a notice of
public hearing pertaining to this utility easement vacation request.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed
to execute said resolution.
