A RESOLUTION SETTING A PUBLIC HEARING DATE CONCERNING AN
AMENDMENT TO A 2E AGREEMENT WITH THE CITY OF CEDAR RAPIDS
WHEREAS, the City of Fairfax is considering amending its March 14, 2001 28E
Agreement with the City of Cedar Rapids.
WHEREAS", the proposed amendment to the 28E Agreement removes those
provisions concerning sanitary sewer services and it addresses annexation boundaries
between the two cities through December 31,2025 pursuant to Section 368.4 of the Code
of Iowa.
WHEREAS, when cities enter into agreements on common boundaries for
purposes of annexation, a public hearing must be held and the City Development Board
and the Linn County Board of Supervisors must receive thirty(30) days' notice of said
hearing and said hearing must be published in an official county newspaper,
NOW, THEREFORE,the City Council of the City of Fairfax,Linn,County,
Iowa, does by this resolution establish the following:
1. That the City of Fairfax shall set a public hearing on the proposed
amendment to the March 14, 2001 28E Agreement between the City of
Fairfax and the City of Cedar Rapids. The public hearing shall be held
at 6:00 p.m. on April 5, 2016, in the City Council Chambers for the
City of Fairfax located at 525 Vanderbilt Sit.,Fairfax, Iowa.
2. The Fairfax City Clerk shall publish notice of this public hearing in

Development Board and Linn County Board of Supervisors in
accordance with 368.4 of the Code of Iowa and shall also provide
copies of this resolution; the proposed amendment to the 28E
Agreement; and the map describing the common line between the City
of Fairfax and the City of Cedar Rapids and notice of the public
hearing.
