RESOLUTION APPROVING A TEMPORARY CONSTRUCTION
EASEMENT AGREEMENT BETWEEN THE CITY OF FAIRFAX AND
THOMAS J. ARP AND PATRICIA A. ARP FOR STOCKPILING SOIL
MATERIALS UPON A PORTION OF LOT 3, ARP'S MEADOWS FIRST
ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA
WHEREAS, City staff has negotiated a Temporary Construction Easement Agreement
(the "AgreemenP') with Thomas J, Arp and Patricia A Arp, Husband and Wife, to stockpile soil
materials upon a portion of Lot 3 of Arp's Meadows First Addition in the City of Fairfax, Linn
County, Iowa (Tax Identification Number 200940101100000) for $1.00 duly paid and
acknowledged contingent on Council approval;
WHEREAS, the Agreement should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
IOWA, THAT:
1. The Agreement, attached hereto and incorporated herein by reference, is approved.
2. The Mayor is authorized to execute all documents necessary to acquire said property in
accordance with the Agreement.
Passed and approved this 121h day of July, 2016.
Council Member Daly moved the adoption of the Resolution; seconded by Council Member Volk.
