HomeMy WebLinkAboutRESOLUTION NO. 2016-132 RESOLUTION NO. 2016-132 RESOLUTION ESTABLISHING SANITARY SEWER CONNECTION FEES RELATIVE TO THE 2016 SANITARY SEWER INTERCEPTOR MAIN EXTENSION PROJECT WHEREAS,the City of Fairfax has constructed a sanitary sewer project known as the 2016 Sanitary Sewer Interceptor Main Extension Project; and WHEREAS, said sanitary sewer project provides potential sanitary sewer service to a number of properties (developed and undeveloped) lying primarily north of Highway 151; and WHEREAS, said potential sanitary sewer service area shall be known as the North Growth Area Drainage Basin, which covers a total area of approximately 2,040 acres and is currently located partly within the City of Fairfax, and partly in Linn County; and WHEREAS, the City of Fairfax has determined that portions of the costs of said sanitary sewer project shall be reimbursed to the City in the form of connection fees in accordance with Chapter 96,02 CONNECTION FEE of the City's Code of Ordinances; and WHEREAS, the City Engineer has calculated,the cost of the 2016 Sanitary Sewer Interceptor Main Extension Project and has established the -fee's for connecting property located within the North Growth Area Drainage Basin to the City's sanitary sewer(s) that are part of the 2016 Sanitary Sewer Interceptor Main Extension Project, or an extension of this project. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa,the following: 1. Sanitary Sewer Connection Fees for the 2016 Sanitary Sewer Interceptor Main Extension,Project located within the North Growth Area Drainage Basin shall be as follows: a. The Connection Fee shall be determined by the entire size of the property that is connecting to the City's Sanitary Sewer, and shall be set as $549.60/acre. b. The Connection Fees established above shall increase at an annual interest rate of 2.25% for a period of up to 3 years, or until the "Bridge Loan" is terminated, and a new, long-term loan is obtained to replace the "Bridge Loan". The first year, calendar year 2017,there shall be no interest applied to these Connection Fees. At the time that the City of Fairfax terminates this "Bridge Loan, and obtains a long-term loan to repay the debt service for this 2016 Sanitary Sewer Interceptor Main Extension Project, another resolution shall be adopted establishing the interest rate and the period of time that the City shall collect interest on the sanitary sewer connection fees for properties that connect to the 2016 Sanitary Sewer Interceptor Main Extension Project, or an extension of this project. c. This sanitary sewer project has been constructed to convey wastewater from the North Growth Area Drainage Basin based upon its size (approximately 2,040 acres), the City's Land Use Map for this area at the time it was designed and constructed in 2016, and a long-range planning map for the North Growth Area established as part of the 2016 Annexation of land located north and west of Highway 151 and 80'h Street. If a property develops at a more intensive use than planned for with the 2016 Sanitary Sewer Interceptor Main Extension Project, or if a property outside of the approximately 2,040-acre North Growth Drainage Basin connects to of the City's Sanitary Sewer System, than the City maintains the right to collect an increased Sanitary Sewer Connection Fee at the City's discretion. 2. The Sanitary Sewer Connection Fees shall be paid to the City Clerk by the applicant prior to the approval by the City of the final plat, or if so decided by the City Council, with the issuance of a building permit of a platted lot, or the sale of a platted lot. If the proposed sanitary sewer connection is not part of a platted subdivision for which these sanitary sewer connection fees have been paid, then the connection fees shall be paid prior to the issuance of a building permit or prior to the applicant's connection to the City's sanitary sewer:main. BE IT FURTHER. RESOLVED, by the Fairfax City Council of the City of Fairfax, Iowa,that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute said resolution.
