RESOLUTION ESTABLISHING HOW WATER MAIN
CONNECTION FEES RELATIVE TO THE HEARTLAND HEIGHTS
DEVELOPMENT IN THE CITY OF FAIRFAX, LINN COUNTY,
IOWA ARE TO BE DETERMINED
WHEREAS, the City of Fairfax has approved the Heartland Heights Preliminary
Plat (389 Acres) as approved by CITY Resolution No. 2016-043; and
WHEREAS, the City has established a water main connection fee for a 12"
equivalent water main of $55.17/LF (in 2016 dollars) of water main for the 2016 water
main extension project, which includes the costs associated with boring this water main
under Highway 151, as approved by the CITY Resolution No. 2016-126; and
WHEREAS, the water main connection fee of a 12" equivalent water main for
the 2016 water main extension project, without the costs associated with boring the water
main under Highway 151, is $48.93/LF (in 2016 dollars); and
WHEREAS, the water main installed along 80"' Street with the 2016 Water Main
Extension Project, and adjacent to the Heartland Heights First Addition, is 862 LF; and
WHEREAS, the estimated 12" equivalent water main remaining to be installed
along 80"' Street and Morgan Bridge Road adjacent to the Heartland Heights
Development 4,576.7 LF; and
WHEREAS, the developer of Heartland Heights, Iowa Lot Development, LLC,
and the City of Fairfax both desire to establish a consistent manner for determining the
connection fees for the subdivisions within the Heartland Heights development.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, the following:
1. The Water Main Connection Fees for the Heartland Heights Development
shall be calculated based upon the total area for each Heartland Heights Final
plat, and shall be determined as follows:
a. 862 LF of water main installed along said Heartland Heights First
Addition, at the rate of$55.17/LF, which includes the costs to bore the
water main under Highway 151. The total water main connection fee
for the initial (2106) Water Main Extension Project to the Heartland
Heights development shall be $47,556.54 (in 2016 dollars).
b. The remainder of all the water main extensions to the Heartland
Heights development (less the 2016 Water Main Extension) shall be
calculated using the 4,576.7 LF of 12" equivalent water main adjacent
to the remaining Heartland Heights development, at the rate of$48.93
/ LF for 12" equivalent water main, which does not include the costs to
bore the water main under Highway 151. The total Water Main
Connection fee for the remainder of the Heartland Heights
development (less the First Addition) shall be $223,937.93 (in 2016
dollars).
c. The Total Water Main Connection Fee for the entire Heartland Heights
development shall be $271,494.47 (in 2016 dollars), which is $697.93
per acre (in 2016 dollars) over the entire 389-acre Heartland Heights
development.
2. All Water Main Connection fees shall be adjusted annually for inflation,
starting on January 1, 2018, based upon the Consumer Price Index (CPI)
established in January each calendar year. All unpaid water main fees shall be
adjusted annually until all Water Main Connection fees within the Heartland
Heights development are paid.
3. All Water Main Connection fees shall be distributed over the Sellable Lots for
each Heartland Heights final plat. All lots that are to be dedicated to the City
of Fairfax (street rights-of-way, storm water detention, etc.) shall be
considered in determining the overall area of each final plat, but no Water
Main Connection fees shall be associated with these dedicated Lots.
4. The Water Main Connection fees shall be calculated for each Heartland
Heights final plat based upon the overall area of the final plat, the cost per
acre, as calculated above, and the inflation beginning on January 1, 2018.
Within each final plat, the Water Main Connection fee shall be determined for
the Single-Family Lots, the Multi-Family Lots, and the Commercial Lots. All
Single-Family Lots within each final plat shall have the same Water Main
Connection fee, regardless of lot size. All Multi-Family Lots within each final
plat shall have the same Water Main Connection fee, regardless of lot size.
All Commercial Lots within each final plat shall have the same Water Main
Connection fee, regardless of lot size.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.
