RESOLUTION ESTABLISHING HOW SANITARY SEWER
CONNECTION FEES RELATIVE TO THE HEARTLAND HEIGHTS
DEVELOPMENT IN THE CITY OF FAIRFAX, LINN COUNTY,
IOWA ARE DETERMINED
WHEREAS, the City of Fairfax has extended City funds to extended sanitary
sewer facilities to service the Heartland Heights development; and
WHEREAS, the City of Fairfax anticipates extending City funds in the future to
extend future sanitary sewer facilities to service the Heartland Height development; and
WHEREAS, the City of Fairfax has established sanitary sewer connection fees
for the existing sanitary sewer facilities extended to the Heartland Heights development
based upon the area that each sanitary sewer project serves; and
WHEREAS, the City of Fairfax intends to establish sanitary sewer connection
fees for the future extension of sanitary sewer facilities which serve the Heartland
Heights development in a consistent manner to how the sanitary sewer connection fees
have been established for the existing sanitary sewer facilities that serve the Heartland
Heights development.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Iowa, the following:
1. The Sanitary Sewer Connection Fees for the Heartland Heights Development
shall be calculated based upon the total area for each Heartland Heights Final
plat.
2. The Sanitary Sewer Connection Fees for the Heartland Heights Development
shall be based upon the total funds that the City extends on each sanitary
sewer extension project that serves the Heartland Heights development, and
shall be applicable to the entire basin in which these sanitary sewer facilities
serve.
3. All Sanitary Sewer Connection fees shall be adjusted annually based upon the
interest the City is paying for each sanitary sewer extension project. All
unpaid Sanitary Sewer Connection fees shall be adjusted annually based upon
these interest rates until all sanitary sewer connection fees within the
Heartland Heights development are paid, or until the periods that the City
pays these interest rates ends.
4. All Sanitary Sewer Connection fees shall be distributed over the Sellable Lots
for each Heartland Heights final plat. All lots that are to be dedicated to the
City of Fairfax (street rights-of-way, storm water detention, etc.) shall be
considered in determining the overall area of each final plat, but no Sanitary
Sewer Connection fees shall be associated with these dedicated Lots.
5. The Sanitary Sewer Connection fees shall be calculated for each Heartland
Heights final plat based upon the overall area of the final plat, the cost per
acre, as specified above, and the interest rate that the City is paying on each
sanitary sewer extension project that services the Heartland Heights
development. Within each final plat, the Sanitary Sewer Connection fee shall
be determined for the Single-Family Lots, the Multi-Family Lots, and the
Commercial Lots. All Single-Family Lots within each final plat shall have the
same Sanitary Sewer Connection fee, regardless of lot size. All Multi-Family
Lots within each final plat shall have the same Sanitary Sewer Connection fee,
regardless of lot size. All Commercial Lots within each final plat shall have
the same Sanitary Sewer Connection fee, regardless of lot size.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of
Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and
directed to execute said resolution.
