HomeMy WebLinkAboutRESOLUTION NO. 2017-22 RESOLUTION NO. 2017-22 RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON VACATING A 30-FOOT ACCESS EASEMENT WHEREAS, the City of Fairfax has received a request to consider vacating a 30-foot access easement from Sobaski Real Estate, L.L.C.; and WHEREAS, the legal description of this easement to be vacated is: The North 30 feet of Lot 2 of James Kurtz's Second Addition to Fairfax, Linn County, Iowa; and WHEREAS,Iowa Code requires a public hearing concerning vacation of these easements; and WHEREAS, interested residents or taxpayers having comments for or against the proposed access easement vacation may appear and be heard at the public hearing at the city council meeting on May 9, 2017, at 6:00 PM at the Fairfax City Hall, at 300 80th Street Court, Fairfax, Iowa. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa, that this confirms that the city council order the publication of a notice of public hearing pertaining to this access easement vacation request. BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute said Resolution. Any person interested may appear at said hearing and be heard. Cynthia Stimson, City Clerk/Treasurer Page 1 APPROVE 2017 AMENDMENT TO FAIRFAX URBAN RENEWAL AREA PLAN 419915-22 Fairfax, Iowa April 11, 2017 The City Council of the City of Fairfax, Iowa, met on April 11, 2017, at 6:00 o'clock, p.m., at the City Hall, for the purpose of conducting a public hearing on a proposed urban renewal plan amendment. The Mayor presided and the roll being called the following members of the Council were present and absent: Present: JoAnn Beer, Joe Kell, and Marianne Wainwright Absent: Mike Daly and Nick Volk It was reported that notice of the intention of the Council to conduct a public hearing on the 2017 Amendment to the urban renewal plan for the Fairfax Urban Renewal Area had been published according to law and as directed by the Council and that this is the time and place at which the Council shall receive oral or written objections from any resident or property owner of the City. All written objections, statements, and evidence heretofore filed were reported to the Council. The following named persons presented oral objections, statements, or evidence as summarized below; filed written objections or statements, copies of which are attached hereto; or presented other exhibits, copies of which are attached hereto: None Discussion was held about the list of projects. There being no further objections, comments, or evidence offered, the Mayor announced the hearing closed. Page 2 Council Member Wainwright moved the adoption of a resolution entitled "A Resolution to Approve 2017 Urban Renewal Plan Amendment for the Fairfax Urban Renewal Area", seconded by Council Member Beer. After due consideration, the Mayor put the question on the motion and the roll being called, the following named Council Members voted: Ayes: Beer, Kell, and Wainwright Nays: None Absent: Daly and Volk. Whereupon, the Mayor declared the resolution duly adopted and signed approval thereto.
