RESOLUTION NO. 2017-23
A RESOLUTION TO APPROVE 2017 URBAN RENEWAL PLAN
AMENDMENT FOR THE FAIRFAX URBAN RENEWAL AREA
WHEREAS, the City Council of the City of Fairfax, Iowa (the "City") has created the
Fairfax Urban Renewal Area (the "Urban Renewal Area") and has approved an urban renewal
plan for the Urban Renewal Area; and
WHEREAS, Chapter 403 of the Code of Iowa requires that, before a city adds property to
an urban renewal area or approves any new urban renewal project, a city must amend the
existing urban renewal plan to describe the new property and to include that new project; and
WHEREAS, an amendment to the urban renewal plan for the Urban Renewal Area has
been prepared which proposes to add to the Urban Renewal Area certain property that was
recently annexed into the City and which describes the use of incremental property tax revenues
for new urban projects related to certain waterworks, street, ball field upgrades and trail
improvements; and
WHEREAS, notice of a public hearing by the City Council on the proposed urban
renewal plan amendment was heretofore given in compliance with the provisions of Chapter 403
of the Code of Iowa, and the Council has conducted the hearing; and
WHEREAS, copies of the urban renewal plan amendment, notice of public hearing and
notice of a consultation meeting with respect to the urban renewal plan amendment were sent to
Linn County and the College Community School District and the consultation meeting was held;
and
WHEREAS, the urban renewal plan amendment was reviewed by the Plan and Zoning
Commission and found to be consistent with the general plan for the City;
NOW, THEREFORE, It Is Resolved by the City Council of the City of Fairfax, Iowa, as
follows:
Section 1. An economic development area as defined in Chapter 403 of the Code of
Iowa is found to exist with respect to the taxable property described in Exhibit A.
Section 2. The property identified in Section 1 hereof is hereby declared to be an
urban renewal area, in conformance with the requirements of Chapter 403 of the Code of Iowa,
and the development of this property is necessary in the interest of the public welfare of the
residents of the City.

Section 3. It is hereby determined by this City Council as follows:
A. The 2017 Amendment to the Urban Renewal Plan for the Fairfax Urban
Renewal Area conforms to the general plan of the City;
B. The proposed projects described in the 2017 Amendment to the Urban
Renewal Plan for the Fairfax Urban Renewal Area are necessary and appropriate to
facilitate the proper growth and development of the City in accordance with sound
planning standards and local community objectives.
Section 4. The 2017 Amendment to the Urban Renewal Plan for the Fairfax Urban
Renewal Area, attached hereto and made a part hereof, is hereby in all respects approved, and the
proposed projects included in such amendment are hereby in all respects approved.
Section 5. All resolutions or parts thereof in conflict herewith are hereby repealed, to
the extent of such conflict.

2017 AMENDMENT
URBAN RENEWAL PLAN
The Urban Renewal Plan for the Fairfax Urban Renewal Area (the "Urban Renewal
Area") is hereby amended in accordance with the provisions of Chapter 403 of the Code of Iowa
to give information about property that is being added to the Urban Renewal Area and new urban
renewal infrastructure projects that are proposed to be undertaken in the Urban Renewal Area.
The property to be added to the Urban Renewal Area includes approximately 114 acres of
property that was recently annexed into the City, located northwest of the former city limits, as
more specifically set out in the legal description attached as Exhibit A.
The following is a list of infrastructure projects and an estimate of incremental property
tax revenues that could be devoted to each project:
-Improvements to the municipal waterworks system, including upgrades to wells and
water main extensions - $230,000
-West Cemetery Road design work - $20,000
-Ball field upgrade - $150,000
-Purchase of property for trail extensions - $80,000
The following information is provided in accordance with the requirements of Section
403.17 of the Code of Iowa:
Outstanding general obligation debt of the City $7,874,000
Constitutional debt limit of the City: $10,493,145
Proposed debt payable from incremental to be incurred
in Urban Renewal Area: $480,000

Beginning at the Point of the Southwest corner of the Northwest Quarter of the Northeast
Quarter of Section 9,Township 82 North, Range 8 West of the 5th Principal Meridian in the City
of Fairfax, Linn County, Iowa; thence north along the west line of said NW%of the NE% Section
9 to the South Quarter Corner of Section 4,T82N, R8 W; thence east along the south line of
Section 4 to the west right-of-way line of 80th Street; thence south along said west right-of-way
line of 80th Street to the intersection of 80th Street and Highway 151, thence southwesterly
