RESOLUTION APPROVING PLACEMENT AND PAYMENT FOR SEVEN
ADDITIONAL STREET LIGHTS FROM LINN COUNTY REC
WHEREAS,the City of Fairfax wishes to add street lights along East Cemetery Road;and
WHEREAS, part of this area is in Linn County REC's service area and they require the
City to sign a Land Owner Release of Linn County Rural Electric Cooperative Association form;
and
WHEREAS, the City of Fairfax has determined that seven Linn County REC street lights
are required, for a cost of$2,100.00, to be paid before the installation.
NOW, THEREFORE, BE IT RESOLVED that the Fairfax City Council does hereby
approve the placement of seven street lights along East Cemetery Road, to be supplied and
powered by Limi County REC for an amount due of$2,100.00.
BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that
the Mayor and City Clerk are hereby authorized and directed to execute said Resolution and Land
Owner Release of Linn County Rural Electric Cooperative Association form.

LINN COUNTY RURAL ELECTRIC COOPERATIVE ASSOCIATION

Linn County Rural Electric Cooperative Association ("LCREC) installing underground electrical lines on
the property. In addition, I have identified the locations of all underground dog fences, drainage tile,
septic tank, sewer lines,water lines and/or all other items installed underground. I have specifically
identified these locations and acknowledge that the route to be dug for installation of LCREC electrical
lines is clear. I further acknowledge that LCREC has hired "One Call" staff to mark all underground lines
in the area and I have not moved any of the flags placed by said staff.
I shall hold harmless LCREC and its directors,officers, agents and employees from all claims
related to LCREC digging along the route it has designated. I also understand and agree to accept all
responsibility for any damages to the lines I identified or any lines that are not identified by me and
could not be identified by the "One Call" staff, unless the planned LCREC digging route is changed
without my knowledge.
This release and all of its intents and purposes shall run with the land regarding the digging by
LCREC in the year of 2017 on the property identified above.

The City Council of the City of Fairfax, Iowa, met on April 11, 2017, at 6:00 o'clock p.m.,
at the City Hall. The Mayor presided and the roll was called showing the following members of
the City Council present and absent:
Present: JoAnn Beer, Joe Kell, and Marianne Wainwright
Absent: Mike Daly and Nick Volk.
Council Member Beer introduced the resolution hereinafter next set out, related to setting
a date for a hearing on a general obligation loan agreement in a principal amount not to exceed
$1,000,000, for the purpose of financing certain infrastructure improvements and refunding the
outstanding balance of certain General Obligation Notes, and moved its adoption, seconded by
Council Member Kell; and after due consideration thereof by the City Council, the Mayor put the
question upon the adoption of the said resolution and the roll being called, the following named
Council Members voted:
Ayes: Beer, Kell, and Volk
Nays: None
Absent: Daly and Volk.
The Mayor declared the resolution duly adopted as hereinafter set out.

At the conclusion of the meeting, and upon motion and vote, the City Council adjourned.
