A RESOLUTION TO PETITION LINN COUNTY
WHEREAS, the City of Fairfax is pursing the rights to a 2015 tax certificate for property
addressed as 510 Church Street, Fairfax, Iowa
WHEREAS, the City of Fairfax incurred the demolition costs in 2009 for nuisance
abatement at this property of$22,331.63
WHEREAS, current value of the City of Fairfax's tax lien against this property is
approximately $37,413.63
WHEREAS, the City of Fairfax's tax lien is included in a 2014 Linn County owned tax
certificate of which the current value is approximately $72,035.16
WHEREAS, when the City of Fairfax obtains the 2015 tax certificate, the Linn County
Board of Supervisors shall be petitioned by the City of Fairfax to remove all other tax liens against
this property
WHEREAS, this action by the Linn County Board of Supervisors will give the City of
Fairfax an unencumbered deed to the property of 510 Church Street, Fairfax
WHEREAS, the City of Fairfax will request the date of this removal of all tax liens
effective after all waiting periods and notice timeframes have expired
WHEREAS, the City of Fairfax may secure a deed for 510 Church Street to sell on the
open market for the amount owed the City against this property at a future date
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, grant the Fairfax Building Department and/or Fairfax City Attorney consent to contact the
Linn County Board of Supervisors and/or Linn County Attorney in order to obtain an agreement
favorable to the City of Fairfax in this matter concerning the 2009, 2010, 2011 and 2012 tax
certificate for 510 Church Street, Fairfax.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk/Treasurer are hereby
authorized and directed to execute said resolution.
