A RESOLUTION TO ALLOW ADDITIONAL BUILDING PERMITS FOR
HEARTLAND HEIGHTS FIRST ADDITION
WHEREAS, the City of Fairfax has not accepted the public improvements at Heartland
Heights First Addition; and
WHEREAS, per the Development Agreement for Heartland Heights First Addition, the
City of Fairfax allows for"at risk building permits"of up to 10% of total number of the lots within
this new addition; and
WHEREAS, currently Heartland Heights First Addition has six "at risk building permits"
issued for new homes; and
WHEREAS, the developer, Iowa Lots LLC, anticipates sales to exceed the allowed total
of 10 permits in the next two months and is requesting an additional 20 "at risk building permits"
before the City of Fairfax accepts the public improvements; and
WHEREAS, City of Fairfax staff is recommending there be no further "at risk building
permits" issued for Heartland Heights First Addition or demanded beyond the original 10 and this
requested 20, making a total of 30. Additional permits beyond these 30 only become available
after the City of Fairfax's acceptance of all public improvements of Heartland Heights First
Addition.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa,that Iowa Lots LLC be granted the ability to issue up to a total of 30"at risk building permits"
for Heartland Heights First Addition before the City of Fairfax has accepted all of the public
improvements.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk/Treasurer are hereby
authorized and directed to execute said resolution.
