RESOLUTION ENTERING INTO A POST-ACCEPTANCE AGREEMENT
FOR THE 2016 SANITARY SEWER INTERCEPTOR
MAIN EXTENSION CONTRACT
WITH CORNERSTONE EXCAVATING, INC.
WHEREAS, the City of Fairfax entered into a contract with Cornerstone Excavating, Inc.
for the 2016 Sanitary Sewer Interceptor Main Extension Project; and
WHEREAS, Hall and Hall Engineers, Inc. is recommending the City of Fairfax add the
attached Post-Acceptance Agreement to the Contract Documents.
NOW, THEREFORE, BE IT RESOLVED that the Fairfax City Council does hereby
approve and enter into this Post-Acceptance Agreement for the 2016 Sanitary Sewer Interceptor
Main Extension Contract with Cornerstone Excavating, Inc., and add this to the Contract
Documents.
BE IT FURTHER RESOLVED, by the City Council of the City of Fairfax, Iowa, that
the Mayor and City Cleric are hereby authorized and directed to execute said Resolution.

POST — ACCEPTANCE AGREEMENT
2016 SANITARY SEWER INTERCEPTOR MAIN EXTENSION
CONTRACT NO. 6950~15~06-CS
THE CITY OF FAIRFAX, IOWA
THIS AGREEMENT is by and between CITY OF FA|RFAX (hereinafter called OWNER) and
CORNERSTONE EXCAVATING (hereinafter called CONTRACTOR).
This Post-Acceptance agreement iatobeadded Uothe Contract Documents,
OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, agree as
follows:
ITEM 1 —HIGHWAY iG1MAINTENANCE
The CONTRACTOR agrees to perform all work necessary to maintain the portion of Highway 151
under which the Sanitary Sewer Main and Casing Pipe were installed. This work will be
performed at the request of and to the satisfaction of the Iowa Department of Transportation. The
CONTRACTOR agrees to maintain this section of road until the upcoming Iowa Department of
Transportation's road project disturbs this area for reconstruction, or the end of the four-year
maintenance bond period

to the City via the Iowa Department of Transportation, the CONTRACTOR shall be responsible
for those costs.
ITEM 2—TELEVISION (AND REPAIR, IF NECESSARY) OF INTERCEPTOR MAIN REPAIR AREAS
The CONTRACTOR agrees to televise the section of Interceptor Main sewer that required
patches during the sanitary sewer installation. The CONTRACTOR shall televise the section
from Manhole 4 (defined as the manhole just north of West Cemetery Road)to Manhole 5 (the
manhole immediately to north of Manhole 4) to ensure that the leak repairs are still fully
functional, If these repairs have failed or are leaking, the CONTRACTOR agrees to repair these
areas. The television and potential subsequent repairs shall be conducted 6 months prior to the
end of the maintenance bonding period, which is four (4) years from the date of project
acceptance,
