RESOLUTION ACCEPTING THE PUBLIC IMPROVEMENTS TO
HEARTLAND HEIGHTS FIRST ADDITION IN THE CITY OF FAIRFAX,
LINN COUNTY, IOWA
WHEREAS, City staff. has performed part-time field observations during the installation
of the public improvements, reviewed material test reports, and has completed a final site
inspection of the public infrastructure, and City staff recommends acceptance of these public
improvements with the following conditions:
1. The 4-year Maintenance Bond for these public improvements is provided to the City of
Fairfax.
2. That the outstanding items on the attached punch list that have not been completed and
signed off by the contractor and the City staff are completed and signed off by City staff
no later than May 18, 2018. The City shall withhold the City's participation on the
sanitary sewer extensions as part of the Heartland Heights First Addition public
improvements until these items have been completed. If these items are not completed
by May 18, 2018, then the City of Fairfax may use this money to complete these
unfinished items.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa,that the public improvements in Heartland Heights First Addition in the City of Fairfax,Linn
County, Iowa are accepted by the City of Fairfax with the following conditions:
1. The 4-year Maintenance Bond for these public improvements is provided to
the City of Fairfax.
2. That the outstanding items on the attached punch list that have not been
completed and signed off by the contractor and the City staff are completed
and signed off by City staff no later than May 18, 2018. The City shall

the Heartland Heights First Addition public improvements until these items

the City of Fairfax may use this money to complete these unfinished items;
and
BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
and the City Clerk/Treasurer are hereby authorized and directed to execute said Resolution.
