RESOLUTION APPROVING THE PLAN OF IMPROVEMENTS
FOR HEARTLAND HEIGHTS SECOND ADDITION IN THE CITY
OF FAIRFAX, LINN COUNTY, IOWA
WHEREAS, a Plan of Improvements dated December 12, 2017, has been
submitted to the City of Fairfax, Iowa, from Iowa Lot Development Co. and Emily
Volesky, E.I, with Shive-Hattery, Inc. for the Plan of Improvements for Heartland Heights
Second Addition Plan in the City of Fairfax, Linn County, Iowa; and
WHEREAS, Hall and Hall Engineers, Inc. has reviewed said Plan of
Improvements for Heartland Heights Second Addition Plan in the City of Fairfax, Linn
County, Iowa and has recommended approval of the Plan of Improvements for the
Heartland Heights Second Addition in the City of Fairfax, Linn County, Iowa with the
following conditions:
1. That all outstanding comments regarding the plan of improvements as detailed in
the Review Letter dated December 12, 2017 are addressed prior to any
construction at Heartland Heights Second Addition.
2. Testing on the public improvements shall be completed by the developer per the
Cedar Rapids Metropolitan Area Design Specifications.
3. That prior to the installation of the sanitary sewer and water main on this site, the
up to date Iowa DNR water main and sanitary sewer construction permits are
obtained, and a copy of each submitted to the City of Fairfax.
4. That prior to performing any improvements on the Second Addition Public
Improvements, the developer or their contractor shall contact the City of Fairfax
and Hall and Hall Engineers, Inc. to coordinate construction observation on these
improvements.
5. That prior to performing any improvements on the improvements within the
public right-of-way where fill is being placed, the developer shall submit
satisfactory compaction test results for the fill material placed within the right-of-
way.
6. That prior to the acceptance of the public improvements, the developer shall
provide the City of Fairfax with GIS As-Built drawings of the public
improvements.
7. That prior to the acceptance of the public improvements, the developer shall
provide the City with a 4-year performance/maintenance bond covering all the
public improvements within the proposed development. An engineer's estimate
for these public improvements shall be submitted with this bond to determine the
amount of the bond.
8. That prior to the acceptance of the public improvements, the developer shall
complete a final plat for Heartland Heights Second Addition, including a
development agreement to be recorded with this final plat.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Fairfax, Iowa,
approves the Plan of Improvements for Heartland Heights Second Addition in the City of
Fairfax, Linn County, Iowa with the conditions as listed above and submitted by Hall and
Hall Engineers, Inc.
BE IT FURTHER RESOLVED,by the City Council of Fairfax, Iowa,that the Mayor
and the City Clerk are hereby authorized and directed to execute said Resolution.
