Home My WebLink AboutRESOLUTION NO. 2018-29 Fairfax419915-22/Set Date2018 AmendUR Plan SET DATE FOR HEARING ON 2018 URBAN RENEWAL PLAN AMENDMENT 419915-22 Fairfax, Iowa May 8, 2018 The Council of the City of Fairfax, Iowa, met on May 8, 2018, at 6:00 o'clock,p.m., at the Fairfax City Hall, at 300 80th Street Court, in the City, for the purpose of setting a date for a public hearing on a proposed amendment to the urban renewal plan for the Fairfax Urban Renewal Area. The Mayor presided and the roll being called,the following members of the Council were present and absent: Present: Michael Daly, Joseph Kell, Jr., and Nicholas Volk Absent: Travis Otto and Marianne Wainwright. The City Clerk reported that a 2018 amendment to the urban renewal plan for the Fairfax Urban Renewal Area had been prepared, in connection with proposed infrastructure improvements in the Fairfax Urban Renewal Area, and that it was necessary to set a date for a public hearing on the proposed amendment. Accordingly, Council Member Volk moved the adoption of the following resolution entitled "Resolution setting date for a public hearing on 2018 amendment to urban renewal plan for Fairfax Urban Renewal Area," and the motion was seconded by Council Member Daly. Following due consideration, the Mayor put the question on the motion and the roll being called, the following named Council Members voted: Ayes: Daly, Kell, and Volk Nays: None. Whereupon, the Mayor declared the resolution duly adopted as follows: -1- DORSEY&WHITNEY LLP,ATTORNEYS,DES MOINES,IOWA Fairfax419915-22/Set Date2018 AmendUR Plan RESOLUTION NO. 2018-29 SETTING DATE FOR PUBLIC HEARING ON 2018 AMENDMENT TO URBAN RENEWAL PLAN FOR FAIRFAX URBAN RENEWAL AREA WHEREAS, the City Council of the City of Fairfax, Iowa (the "City") has created the Fairfax Urban Renewal Area(the"Urban Renewal Area")and has approved an urban renewal plan for the Urban Renewal Area; and WHEREAS, Chapter 403 of the Code of Iowa requires that, before a city adds property to an urban renewal area or approves any new urban renewal project, a city must amend the existing urban renewal plan to describe the property and that new project; and WHEREAS, an amendment to the urban renewal plan for the Urban Renewal Area has been prepared which describes the potential use of incremental property tax revenues for new urban renewal projects in connection with certain infrastructure improvements in the Urban Renewal Area, and it is now necessary that a date be set for a public hearing on that plan amendment; NOW, THEREFORE, Be It Resolved by the City Council of the City of Fairfax, Iowa, as follows: Section 1. This City Council will meet at the Fairfax City Hall, at 300 80t"Street Court, Fairfax, Iowa, on the 12th day of June, 2018, at 6:00 o'clock p.m., at which time and place it will hold a public hearing on the proposed 2018 urban renewal plan amendment for the Fairfax Urban Renewal Area. Section 2. The City Clerk shall publish notice of said hearing, the same being in the form attached hereto, which publication shall be made in a legal newspaper of general circulation in Fairfax, which publication shall be not less than four(4) nor more than twenty (20) days before the date set for hearing. Section 3. Pursuant to Section 403.5 of the Code of Iowa, the City Clerk is hereby designated as the City's representative in connection with the consultation process which is required under that section of the urban renewal law. A copy of the amendment is on file for public inspection in the office of the City Clerk. The infrastructure projects include the following: -Heartland Heights City participation improvements to sanitary sewers, trails, and plantings/seeding -Construction of a splash pad at The Complex, a city park on Linn Street -Acquisition of property for West Cemetery Road improvement and bridge realignment -Acquisition of property (Outlot B, Heartland Heights First Addition) for city park Incremental property tax revenues will also be used in connection with refinancing outstanding interim financing for municipal water and sanitary sewer improvements. It is estimated that the potential use of tax increment revenues for the projects will not exceed $2,290,900. At the hearing any interested person may file written objections or comments and may be heard with respect to the subject matters of the hearing.
