RESOLUTION APPROVING PROPOSED TERMINATION OF EASEMENT AGREEMENTS
WHEREAS, City staff has negotiated an Agreement to Terminate and Vacate Easement
for Storm Sewer Facilities in which the City of Fairfax, Iowa will terminate its Easement for
Storm Sewer Facilities Agreement with Sobaski Real Estate, LLC that was recorded on May 12,
2017 at Book 9829, pages 659-663 in the office of the Linn County Recorder, contingent on
Council approval;
WHEREAS, City staff has negotiated an Agreement to Terminate and Vacate Access
Easement in which the City of Fairfax, Iowa will terminate its Access Easement Agreement with
Sobaski Real Estate, LLC that was recorded on May 12, 2017 at Book 9829, pages 644-651 in
the office of the Linn County Recorder, contingent on Council approval;
WHEREAS, the City believes the aforementioned Agreements are in the best interest of
the City of Fairfax; and
WHEREAS, the aforementioned Agreements should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRFAX,
IOWA, THAT:
1. The aforementioned Agreements, attached hereto as Exhibit "A" and Exhibit "B" and
incorporated herein by reference, are approved.
3. The Mayor is authorized to execute all documents necessary to terminate the
easements in accordance with the Agreements.
Passed and approved this 11th day of September, 2018.

Council Member Wainwright moved the adoption of the Resolution: Seconded by Council
Member Daly.
