HomeMy WebLinkAboutRESOLUTION NO. 2019-05 RESOLUTION NO. 2019®05 SOLUTION ENTERING INTO AN AGREEMENT BETWEEN THE IOWA DEPARTMENT OF TRANSPORTATION AND THE CITY OF FAIRFAX, LINN COUNTY, IOWA WHEREAS, the City Council of the City of Fairfax, Iowa, is in receipt of a revised Agreement with the Iowa Department of Transportation which outlines the responsibilities of both parties for improvements to U. S. 151 within the City of Fairfax, Linn County Iowa; and WHEREAS, the City Council of the City of Fairfax, Iowa agrees to these improvements and cost sharing for such. NOW THEREFORE, IT IS RESOLVED by the City Council of the City of Fairfax, Linn County, Iowa, that the City of Fairfax enter into this proposed Agreement with the Iowa Department of Transportation to establish responsibilities for the U. Project Information a. The DOT will design, let, and inspect construction of the following described project in accordance with the project plans and DOT standard specifications: Bridge replacements on U.S. 151 over the UP Railroad, Prairie Creek and a drainage ditch, and grade and Portland Cement Concrete(PCC)Pave from approximately 0.2 miles south of Church Street in Fairfax to south of Dean Road. b. As part of the project, the LPA has requested extension of Church Street westerly to Sta. 1847+69.25,construction of water main and construction of sanitary sewer within the city all at no cost to the DOT.(See Exhibit A for location and Exhibit B for costs). c. In accordance with 761 Iowa Administrative Code Chapter 150.3(1)d,the LPA will reimburse the DOT for its share of the actual cost for longitudinal and outlet storm sewer as shown on Exhibit B. d. All storm sewers constructed by the DOT as part of the project will become the property of the LPA, which will be responsible for their maintenance and operations. The LPA will not make any connections to said storm sewers without the prior written approval of the DOT.The LPA will prevent use of such storm sewers as a sanitary sewer. 2019-4-048—Fairfax 1 July 2014 e. The LPA agrees to relocate the Veterans Memorial located north of Church Street and west of U.S. 151 prior tothe start ofconstruction. [ Upon completion of construction,the LPA agrees to accept ownership and jurisdiction of the following referenced improvements. The LPA shall also assume responsibility for all future maintenance operations associated therewith, all at no additional expense or obligation to the DOT: i. Pedestrian accommodations for a14-0notbridge clear width will beprovided onthe structures over the UP Railroad at station 857+23.6, Prairie Creek at station 867+41.7, and a drainage ditch at station 88O+85which also providesmnaccommodation for afuture trail underpass. AnyeddKione| ADA complaint pedestrian improvements would be developed and constructed under the purview of the LPA and at no cost to the DOT. The LPA shall be responsible for obtaining any necessary permits from the DOT and all project permits and/or approvals from controlling State or Federal agencies. h. The entrance pipe and intake atSta. 878+31.00. Left, identified in the plans oestorm sewer lines P- 34and P-35, intake ST-35 and ST'34and ST-36 will be owned and maintained by DOT. 2. Project Costs a. The following storm sewer intakes, manholes, and storm sewer lines will be paid for 100%by the LPA: 8T-08. ST-OA, ST-10, ST-28, ST-29. GT-30. SN-02. P-08, P-00, P-10. P-28, P-29, P-38. P- S01, and P-G02. b. The following storm sewer intakag, manho|es, and storm sewer lines will be paid for 79%by the LPA and 21% bythe DOT: ST-16. GT-17. GT-18. ST-31. ST-32. GT-33. P-02. P-03, P-U4. P-O5. P-07. P- 15, P-16. P47. P-31. and P-32 o. Lump Sum items are proportioned along the plan divisions based as a percentage of the estimated cost ofthe division ietothe estimated total project construction cost. d. The total cost toLPA isestimated tobe$188.73G(1V096Division 2)+$Q5.947(7996Division 3)= $294,683. e. The LPA shall reimburse the DOT for its share ofthe project costs estimated at$2Q4.G83. asshown in Exhibit B. The amount paid by the LPA upon completion of construction and proper billing by the DOT will be determined by the actual quantities in place and the accepted bid at the contract leffing. t The DOT will bear all costs except those allocated to the LPA under other terms of this Agreement. 20194-048—Faidax 2 July 2014 3. Tmaff ic Control a. Local traffic will bemaintained during the construction. b. The DOT will temporarily close the highway project area by formal action in accord with Iowa Code section 306.41. U.S. 151 traffic will be detoured off of the project on County Road E70ANright Brothers Boulevard from U.S. 151 to 1-380. on 1-380homVVhQht Brothers Boulevard to U.G. 30. on U.S. 30 from 1-380 to U.S. 151. o. The LPA will authorize the DOT to erect and maintain signs within its jurisdiction, consistent with Part 6 of the"Manual on Uniform Traffic Control Devices", as necessary to direct traffic to and along said detour route during the construction period. The DOT will also remove said signs when the detour is discontinued. Details will be shown on the traffic control sheet(s)within the project plans. d. If it becomes necessary to temporarily close LPA side roads during construction,the DOT will furnish and install the required barricades and signing for the closure at project cost and shall remove same upon completion of the project also at no expense or obligation to the LPA. The DOT will work in close cooperation with the LPA and the contractor to accommodate emergency services and local access across the project during construction. Any detours which may be necessary for project related LPA road closures will be the responsibility of the LPA all at no expense or obligation to the DOT. 4. Construction&Maintenance o. The LPA, in cooperation with the DOT,will take whatever steps may be required with respect to alteration ofthe grade lines ofthe ehighway facilities constructed under the project in accordance with Iowa Code section 3S4.15.The DOT and LPA will work together tuminimize potential impacts tn properties that may occur aoaresult ofthe project. b. Upon completion of the project, no changes in the physical features thereof will be undertaken or permitted without the prior written approval of the DOT. o. Future maintenance of the primary highway within the project area will be carried out in accordance with the terms and conditions contained in761 Iowa Administrative Code Chapter 15O. d. Structures built by the DOT over or under a primary road will be maintained structurally sound by the DOT, including repairs to floors and railing and painting. For structures serving roadways which are not on the primary road system, the cleaning and removal of snow, debris and foreign objects from local road traffic lanes, sidewalks or walkways within the project limits (if any) including pedestrian overpasses orunderpasses will bathe responsibility nfthe LPA. 5. General Provisions o. If the LPA has completed a Flood Insurance Study(FIS)for an area which is affected by the proposed Primary Highway project and the FIS is modified, amended or revised in an area affected by the the date ofthis Agreement, the LPA shall promptly provide notice ofthe modiDcation, amendment or revision to the DOT. If the LPA does not have o detailed Flood Insurance Study(FIS)for an area which is affected by the proposed Primary Highway project and the LPA does adopt an AS in an area affected by the project after the date of this Agreement, the LPA shall promptly provide notice ofthe FIS tothe DOT. 2019-4-048—Fairfax 3 July 2014 b The LPA will comply with all provisions ofthe equal employment opportunity requirements prohibiting discrimination and requiring affirmative action to assure equal employment opportunity as required by Iowa Code Chapter 216. If any section, provision, or part of this Agreement shall be found to be invalid or unconstitutional, such finding shall not affect the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional, except to the extent that the original intent of the Agreement cannot bafulfilled. e. This Agreement may be executed in(two)counterparts, each of which so executed willbe deemed to beanoriginal. t This Agreement, aawell asthe unaffected provisions ofany previous agreement(s), addendum(s), and/or amendment(s); represents the entire Agreement between the LPA and DOT regardingthin project. All previously executed agreements will remain in effect except as amended herein. Cy thia Stimson,City.Clerk/Treasurer µ,\g d - aF July 2014 IOWA DEPARTMENT OF TRANSPORTATION Preconstruction Agreement For Primary Road Project County Linn City Fairfax Project No. NHSX-151-3(158)--3H-57 BRF-151-3(141)--38-57 BRF-151-3(142)--38-57 BRF-151-3(152)-38-57 Iowa DOT Agreement No. 20194-048 Staff Action No. S-2019-0567 This Agreement, is entered into by and between the Iowa Department of Transportation, hereinafter designated the"DOT",and the city of Fairfax, Iowa, a Local Public Agency, hereafter designated the"LPA" in accordance with Iowa Code Chapters 28E, 306, 306A and 313.4 as applicable; The DOT proposes to establish or make improvements to U.S. 151 within Linn County, Iowa; and The DOT and the LPA are willing to jointly participate in said project, in the manner hereinafter provided; and The DOT and the LPA previously entered into the following agreement(s)for the above referenced project: Agreement No.2017-1-263 for right of way acquisition was executed by the DOT and LPA on May 23,2017 and May 10,2017 respectively;and This Agreement reflects the current concept of this project which is subject to modification by mutual agreement between the LPA and the DOT; and Therefore, it is agreed as follows: 1. Project Information a. The DOT will design, let,and inspect construction of the following described project in accordance with the project plans and DOT standard specifications: Bridge replacements on U.S. 151 over the UP Railroad, Prairie Creek and a drainage ditch, and grade and Portland Cement Concrete(PCC)Pave from approximately 0.2 miles south of Church Street in Fairfax to south of Dean Road. b. As part of the project,the LPA has requested extension of Church Street westerly to Sta. 1847+69.25,construction of water main and construction of sanitary sewer within the city all at no cost to the DOT.(See Exhibit A for location and Exhibit B for costs). c. In accordance with 761 Iowa Administrative Code Chapter 150.3(1)d, the LPA will reimburse the DOT for its share of the actual cost for longitudinal and outlet storm sewer as shown on Exhibit B. d. All storm sewers constructed by the DOT as part of the project will become the property of the LPA, which will be responsible for their maintenance and operations.The LPA will not make any connections to said storm sewers without the prior written approval of the DOT.The LPA will prevent use of such storm sewers as a sanitary sewer. 2019-4048 Fairfax 1 July 2014 e. The LPA agrees to relocate the Veterans Memorial located north of Church Street and west of U.S. 151 prior to the start of construction. f. Upon completion of construction,the LPA agrees to accept ownership and jurisdiction of the following referenced improvements.The LPA shall also assume responsibility for all future maintenance operations associated therewith, all at no additional expense or obligation to the DOT: i. Church St., from Sta. 1847+69.25 to Sta. 1851+25.00, 355.75 Lin. Ft. A 36-foot wide paved roadway will be provided. ii. Prairie Ave., from Sta. 2863+97.80 to Sta.2866+56.00, 258.20 Lin. Ft. A 23-foot wide paved roadway will be provided. iii. Losey Ave., from Sta. 3862+86.45 to Sta. 3864+80.81, 194.36 Lin. Ft. A 23-foot wide paved roadway will be provided. iv. Stallman Dr., from Sta. 4874+25.00 to Sta. 4875+81.00, 156.00 Lin. Ft. A 25-foot wide paved roadway will be provided. V. Cemetery Rd., from Sta. 5882+30.00 to Sta. 5885+42.00, Lin. Ft. A 25-foot wide paved roadway will be provided. g. Pedestrian accommodations for a 14-foot bridge clear width will be provided on the structures over the UP Railroad at station 857+23.6, Prairie Creek at station 867+41.7, and a drainage ditch at station 880+85 which also provides an accommodation for a future trail underpass. Any additional ADA complaint pedestrian improvements would be developed and constructed under the purview of the LPA and at no cost to the DOT. The LPA shall be responsible for obtaining any necessary permits from the DOT and all project permits and/or approvals from controlling State or Federal agencies. h. The entrance pipe and intake at Sta. 878+31.00, Left, identified in the plans as storm sewer lines P- 34 and P-35, intake ST-35 and ST-34 and ST-36 will be owned and maintained by DOT. 2. Project Costs a. The following storm sewer intakes, manholes, and storm sewer lines will be paid for 100%by the LPA: ST-08, ST-09, ST-10, ST-28, ST-29, ST-30, SN-02, P-08, P-09, P-10, P-28, P-29, P-30, P- S01, and P-S02. b. The following storm sewer intakes, manholes, and storm sewer lines will be paid for 79%by the LPA and 21%by the DOT: ST-16, ST-17, ST-18, ST-31, ST-32, ST-33, P-02, P-03, P-04, P-05, P-07, P- 15, P-16, P-17, P-31, and P-32. c. Lump Sum items are proportioned along the plan divisions based as a percentage of the estimated cost of the division is to the estimated total project construction cost. d. The total cost to LPA is estimated to be$198,736(100%Division 2)+$95,947(79%Division 3)= $294,683. e. The LPA shall reimburse the DOT for its share of the project costs estimated at$294,683, as shown in Exhibit B. The amount paid by the LPA upon completion of construction and proper billing by the DOT will be determined by the actual quantities in place and the accepted bid at the contract letting. f. The DOT will bear all costs except those allocated to the LPA under other terms of this Agreement. 2019-4-048—Fairfax 2 July 2014 3. Traffic Control a. Local traffic will be maintained during the construction. b. The DOT will temporarily close the highway project area by formal action in accord with Iowa Code section 306.41. U.S. 151 traffic will be detoured off of the project on County Road E70mright Brothers Boulevard from U.S. 151 to 1-380, on 1-380 fromWright Brothers Boulevard to U.S. 30, on U.S. 30 from 1-380 to U.S. 151. c. The LPA will authorize the DOT to erect and maintain signs within its jurisdiction, consistent with Part 6 of the"Manual on Uniform Traffic Control Devices", as necessary to direct traffic to and along said detour route during the construction period.The DOT will also remove said signs when the detour is discontinued. Details will be shown on the traffic control sheet(s)within the project plans. d. If it becomes necessary to temporarily close LPA side roads during construction,the DOT will furnish and install the required barricades and signing for the closure at project cost and shall remove same upon completion of the project also at no expense or obligation to the LPA. The DOT will work in close cooperation with the LPA and the contractor to accommodate emergency services and local access across the project during construction. Any detours which may be necessary for project related LPA road closures will be the responsibility of the LPA all at no expense or obligation to the DOT. 4. Construction&Maintenance a. The LPA, in cooperation with the DOT,will take whatever steps may be required with respect to alteration of the grade lines of the new highway facilities constructed under the project in accordance with Iowa Code section 364.15. The DOT and LPA will work together to minimize potential impacts to properties that may occur as a result of the project. b. Upon completion of the project, no changes in the physical features thereof will be undertaken or permitted without the prior written approval of the DOT. c. Future maintenance of the primary highway within the project area will be carried out in accordance with the terms and conditions contained in 761 Iowa Administrative Code Chapter 150. d. Structures built by the DOT over or under a primary road will be maintained structurally sound by the DOT, including repairs to floors and railing and painting. For structures serving roadways which are not on the primary road system, the cleaning and removal of snow, debris and foreign objects from local road traffic lanes, sidewalks or walkways within the project limits(if any) including pedestrian overpasses or underpasses will be the responsibility of the LPA. 5. General Provisions a. If the LPA has completed a Flood Insurance Study(FIS)for an area which is affected by the proposed Primary Highway project and the FIS is modified, amended or revised in an area affected by the project after the date of this Agreement, the LPA shall promptly provide notice of the modification, amendment or revision to the DOT. If the LPA does not have a detailed Flood Insurance Study(FIS)for an area which is affected by the proposed Primary Highway project and the LPA does adopt an FIS in an area affected by the project after the date of this Agreement, the LPA shall promptly provide notice of the FIS to the DOT. 2019-4-048—Fairfax 3 July 2014 b. The LPA will comply with all provisions of the equal employment opportunity requirements prohibiting discrimination and requiring affirmative action to assure equal employment opportunity as required by Iowa Code Chapter 216. No person will, on the grounds of age, race, creed, color,sex, sexual orientation, gender identity, national origin, religion, pregnancy, or disability, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which State funds are used. c. It is the intent of both (all) parties that no third party beneficiaries be created by this Agreement. d. If any section, provision, or part of this Agreement shall be found to be invalid or unconstitutional, such finding shall not affect the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional, except to the extent that the original intent of the Agreement cannot be fulfilled. e. This Agreement may be executed in(two)counterparts, each of which so executed willbe deemed to be an original. f. This Agreement, as well as the unaffected provisions of any previous agreement(s), addendum(s), and/or amendment(s); represents the entire Agreement between the LPA and DOT regarding this project. All previously executed agreements will remain in effect except as amended herein.
