RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC
HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND
ORAL COMMENTS ON VACATING A TELEPHONE EASEMENT
WHEREAS, the South Slope Cooperative has indicated that they no longer utilize the
existing Telephone Line Right-of-Way Easement that is on the City of Fairfax property located
in the Southwest Quarter of the Northeast Quarter of Section 16, Township 82 North, Range 8
West of the 5th Principal Meridian, in the City of Fairfax, Linn County, Iowa; and
WHEREAS, the City of Fairfax desires to vacate this Telephone Easement located on
City property; and
WHEREAS, Iowa Code requires a public hearing concerning vacation of this
Telephone Easement; and
WHEREAS, interested residents or taxpayers having comments for or against the
vacation of this Telephone Easement may appear and be heard at the public hearing at the city
council meeting on May 14, 2019, at 6:00 PM at Fairfax City Hall, located at 300 80th Street
Court, PO Box 337, Fairfax, Iowa.
NOW,THEREFORE,BE IT RESOLVED,by the City Council of the City of Fairfax,
Iowa, that this confirms that the City council order the publication of a notice of public hearing
pertaining to the vacation of an the existing Telephone Easement on City property.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.
