RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC
HEARING FOR THE PURPOSE OF ADJUSTMENT OF DRAINAGE
EASEMENT WIDTH
WHEREAS,the City of Fairfax has storm sewer from Driftwood Park south under East
Cemetery Road draining into another drainage easement that the city purchased for drainage
directly into Prairie Creek; and
WHEREAS, the City of Fairfax desires to reduce the size of the existing drainage
easement on private property defined by southern lot lines on lots 1-8 of Prairie Creek Estates
1St Addition; and
WHEREAS, Iowa Code requires a public hearing concerning vacation of part of this
public Drainage Easement; and
WHEREAS, interested residents or taxpayers having comments for or against the
vacation of part of this public Drainage Easement may appear and be heard at the public hearing
at the City council meeting on May 14, 2019, at 6:00 PM at Fairfax City Hall, located at 300
80th Street Court, PO Box 337, Fairfax, Iowa.
NOW,THEREFORE,BE IT RESOLVED,by the City Council of the City of Fairfax,
Iowa, that this confirms that the City council order the publication of a notice of public hearing
pertaining to the vacation of part of an the existing public Drainage Easement on private
property.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.
