RESOLUTION "VACATING AND TERMINATING A TELEPHONE
EASEMENT ON CITY PROPERTY
WHEREAS, the South Slope Cooperative has indicated that they no longer utilize the
existing Telephone Line Right-of-Way Easement that is on the City of Fairfax property located
in the Southwest Quarter of the Northeast Quarter of Section 16, Township 82 North, Range 8
West of the 5t" Principal Meridian, in the City of Fairfax, Linn County, Iowa; and
WHEREAS, the City of Fairfax desires to vacate and terminate this Telephone
Easement located on City property; and
WHEREAS, South Slope Cooperative has submitted a signed document indicating that
they no longer use the facilities located within this easement; and
WHEREAS, a public hearing concerning the vacation and termination of this
Telephone Easement has been held; and
WHEREAS, Hall and Hall Engineers, Inc. has reviewed said Telephone Line Right-of-
Way Easement Vacation and Termination request and recommends said easement be vacated
and terminated.
NOW,THEREFORE,BE IT RESOLVED,by the City Council of the City of Fairfax,
Iowa, that the Vacation and Termination of the Telephone Line Right-of-Way Easement that is
on the City of Fairfax property located in the Southwest Quarter of the Northeast Quarter of
Section 16, Township 82 North, Range 8 West of the 5t" Principal Meridian, in the City of
Fairfax, Linn County, Iowa, is hereby acknowledged and approved on the part of the City of
Fairfax, Linn County, Iowa.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.
