RESOLUTION VACATING AND TERMINATING THE NORTH 10-
FEET OF A 35-FOOT WIDE DRAINAGE EASEMENT
WHEREAS, there is a 35-wide Drainage Easement located along the rear (south)
property line of Lots 1 through 8 all-inclusive, Prairie Creek Estates First Addition to the City
of Fairfax, Linn County, Iowa; and
WHEREAS, the City of Fairfax desires to vacate and terminate the North 10-feet of
said Drainage Easement located along the rear (south) property line of Lots 1 through 8, all-
inclusive, Prairie Creek Estates First Addition to the City of Fairfax, Linn County, Iowa; and
WHEREAS,a public hearing concerning the vacation and termination of the North 10-
feet of said Drainage Easement has been held; and
WHEREAS, City staff has reviewed the City's interests in the north 10-feet of said
Drainage Easement and finds that the North 10-feet of said Drainage Easement is no longer
necessary to serve the public interest, and City staff further recommends that the North 10-feet
of said Drainage Easement be vacated and terminated.
NOW,'THEREFORE,BE IT RESOLVED,by the City Council of the City of Fairfax,
Iowa, that the Vacation and Termination of the North 10-Feet of the Drainage Easement that is
located along the rear (south) property line of Lots 1 through 8, all-inclusive, Prairie Creek
Estates First Addition to the City of Fairfax, Linn County, Iowa, is hereby acknowledged and
approved on the part of the City of Fairfax, Linn County, Iowa.
BE IT FURTHER RESOLVED, by the Fairfax City Council of the City of Fairfax,
Iowa, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute
said resolution.
