RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC
HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL
COMMENTS ON A REZONING REQUEST
WHEREAS,the Zach Sobaski, on behalf of Sobaski Real Estate, has filed an Application
for Change of Zoning for 50 Stallman Drive, more particularly known as:
Lot 3, McGinness First Addition to Fairfax, Iowa except that part more particularly
described as follows: Commencing at the center of Section 9-82-8, thence South
02°22'51"East along the East line of the SW 1/4 of said Section 9, a distance of 817.73 feet
to the Easterly corner of said Lot 3 and the point of beginning; thence South 08°32'24"
West continuing along said East line of said Lot 3, a distance of 237.30 feet; thence South
00°47'24" West continuing along said East line, 218.90 feet; thence South 02°20'51" East
continuing along said East line, 156.67 feet to the South line of said Lot 3; thence South
88°01'20" West along said South line, 34.90 feet; thence North 00°47'40" West, 204.24
feet; thence North 05°05'00" East, 291.48 feet; thence North 20°32'06" East, 124.66 feet
to the point of beginning
Subject nevertheless to easements, covenants, conditions and restrictions of record
WHEREAS, Iowa Code requires a public hearing concerning rezoning of this property;
and
WHEREAS, interested residents or taxpayers having comments for or against the
proposed rezoning may appear and be heard at the public hearing at the city council meeting on
November 12, 2019, at 6:00 PM at the Fairfax City Hall, at 300 80"' Street Court, Fairfax, Iowa.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Iowa, that this confirms that the city council order the publication of a notice of public hearing
pertaining to this rezoning request on behalf of the City of Fairfax.
BE IT FURTHER RESOLVED,by the Fairfax City Council of the City of Fairfax, Iowa,
that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute said
resolution.
