RESOLUTION APPROVING THE AT-RISK GRADING
IMPROVEMENTS TO THE HEARTLAND HEIGHTS WET POND,
WATER QUALITY BASIN NO. 1, AND THE EMBANKMENTS OF THE
NORTH-SOUTH STREAM, ALL IN THE CITY OF FAIRFAX, LINN
COUNTY, IOWA
WHEREAS, Plan of Improvements for the Heartland Heights Wet Pond, the adjacent
Water Quality Basins 1, 2, and 3, the Sanitary Sewer Trunk Main Extension, The perimeter pond
trail, and the trail bridge, have been submitted to the City of Fairfax by Emily Volesky with
Shive Hattery Architecture and Engineering, on behalf of Iowa Lot Development and Schrader
Excavating and Grading Co.; and
WHEREAS, This Wet Pond and Stream Embankment Grading is permitted under the
U.S. Army Corps of Engineers Nationwide Permit Numbers 13 and 29, as well as Iowa DNR
Flood Plain Development Permit No. FP2019-174.; and
WHEREAS, Hall and Hall Engineers, Inc. has reviewed said plan of improvements and
there appears to be some issues that still need to be addressed with the perimeter trail; the
perimeter drainage to the wet pond; the overflow drainage swale; and the sanitary sewer trunk
main. These items do not impact the grading of the wet pond; the water quality basin no. 1; or
the embankment grading of the north-south stream; and
WHEREAS, Hall and Hall Engineers, Inc. has recommended approval of an At-Risk Grading
Permit for Iowa Lot Development and Schrader Excavating and Grading Co. for the rough
grading of the Wet Pond, the Water Quality Basin No. 1, and the North-South Stream
Embankments with the following conditions:
1. That the City of Fairfax, Iowa shall not be responsible for any changes to the Grading
Plan for the Wet Pond; Water Quality Basin No. 1, or the North-South Stream
Embankments that may be made prior to the final approval of these plan of
improvements.
2. That rough grading of the wetland areas per these plan of improvements and the
planting plan that is part of the proposal from EB Solutions, dated June 4, 2018
(including both Emergent and Submerged Wetlands) shall be graded approximately
6-inches lower than the finish grade so that 6 to 8-inches of topsoil can be placed
back over these areas and then disked-in/mixed with the 6-inches of clay material
located immediately below.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Fairfax, Iowa,
that the At-Risk Grading Permit for Iowa Lot Development and Schrader Excavating and
Grading Co. for the rough grading of the Wet Pond, the Water Quality Basin No. 1, and the
North-South Stream Embankments with the following conditions:
1. That the City of Fairfax, Iowa shall not be responsible for any changes to the Grading
Plan for the Wet Pond; Water Quality Basin No. 1, or the North-South Stream
Embankments that may be made prior to the final approval of these plan of
improvements.

BE IT FURTHER RESOLVED, by the City Council of Fairfax, Iowa, that the Mayor
and the City Clerk/Treasurer are hereby authorized and directed to execute said Resolution.
