RESOLUTION PROVIDING FOR THE CERTIFICATION OF
DELINQUENT CITY OF FAIRFAX UTILITY CHARGES TO THE
COUNTY TREASURER FOR COLLECTION IN THE SAME
MANNER AS TAXES
WHEREAS,the City of Fairfax has established municipal utilities and provided,
by ordinance for rates for such services as permitted by law; and
WHEREAS, the Iowa Code Section 384.84 provides for the collection of
delinquent utility accounts for the premises served in the same manner as real estate taxes
upon certification to the County Treasurer; and
WHEREAS,there now exists a substantial delinquency including late payment
penalties in one or more municipal utility accounts as specified herein;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAIRFAX, IOWA:
The Linn County Treasurer is requested and directed to assess all such charges, together
with an administrative charge of$10 as provided in Iowa Code Section 384.84(4), for a
total of$425.00 to the premises served and collect in the same manner as taxes as
provided by law.
1. Delinquent Amount:
Unpaid Solid Waste Service fees $220.00
Unpaid Late Penalties $195.00
$415.00
2. Administrative Charge:
City of Fairfax $5.00
Linn County Treasurer $5.00
Total to certify for collection: $425.00

If the above amount plus late payment penalties is not paid in full by the above property
owner by January 11, 2020, we the City Council of the City of Fairfax direct the Deputy
City Clerk-Utilities or the City Clerk/Treasurer to certify this delinquent utility account to
the Linn County Treasurer to be collected in the same manner as real estate taxes. Late
penalties will continue to accrue on this account with the city until it is paid in full and such
penalties may be certified to the Linn County Treasurer again at a future date for any unpaid
charges/fees/penalties.
