Mayor Beer called the meeting to order at 6:00 PM. Council members present: Tom Nurre, Mike Daly, Nick Volk, and Marianne Wainwright. Dan Wozniak was absent. Motioned by Daly, seconded by Nurre to approve the consent agenda. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Absent: Wozniak. Motion carried. Mayor Beer read the 2025 Stand Down Proclamation, proclaiming September 4, 2025, as the th 19 Annual Five Seasons Stand Down Day. A Linn County Deputy Sheriff presented the list of calls. Mayor Beer opened a Public Hearing regarding an amendment to the Multi-Family Zoning District regulations at 6:05 PM. City Administrator Chris Philipp gave a summary of the proposed change. It is to allow zero lots with up to two units on a lot zoned multi-family. Discussion was held about the two pictures in the packet. Limiting this to two units will have only one shared wall and each unit will have a side-yard requirement. This change is being proposed based on input from current condo owners and developers. Mayor Beer closed the meeting at 6:09 PM. Mayor Beer referred to an email from Dan Wozniak about timing of action on this proposal. Bruce Sevig and Shane Schrader stated Iowa Lots has sales pending on these types of lots. If the City Council chooses to make this change, they asked City Council to consider waiving the other readings and giving final approval this evening. Motioned by Daly, seconded by Wainwright to introduce and approve the first reading of ORDINANCE 122, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING TO SECTION 1.05.B DEFINITIONS AND BY AMENDING SECTION 1.07.C.A.5 PERMITTED PRINCIPAL USES AND STRUCTURES. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Motioned by Daly, seconded by Wainwright to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 122. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Motioned by Daly, seconded by Nurre to give final approval of ORDINANCE 122, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING TO SECTION 1.05.B DEFINITIONS AND BY AMENDING SECTION 1.07.C.A.5 PERMITTED PRINCIPAL USES AND STRUCTURES. KJOSA FOR CONNECTION TO THE CITY OF FAIRFAX’S SANITARY SEWER SYSTEM AT PARCEL A, PLAT OF SURVEY NO. 1336. Roll call vote: Ayes: Nurre, Daly, and Volk. Nays: Wainwright. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-102 duly adopted. Motioned by Daly, seconded by Nurre to approve RESOLUTION 2025-103, A RESOLUTION APPROVING THE SANITARY SEWER FACILITIES EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT ON A PORTION OF PARCEL A, PLAT OF SURVEY NO. 1336. Roll call vote: Ayes: Nurre, Daly, and Volk. Nays: Wainwright. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-103 duly adopted. Motioned by Volk, seconded by Daly to approve RESOLUTION 2025-104, A RESOLUTION FOR THE AWARD OF THE SANITARY SEWER EXTENSION PROJECT TO 6811 WILLIAMS BLVD. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-104 duly adopted. Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2025-105, A RESOLUTION FOR APPROVING THE FORM OF CONTRACT FOR THE SANITARY SEWER EXTENSION PROJECT TO 6811 WILLIAMS BLVD. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-105 duly adopted. Lengthy discussion was held about Alliant Energy’s proposed power generation plant information. Marty Lenss with the Eastern Iowa Airport, stated the airport’s commission is opposed to the proposed site due to height, air volatility, and plumes. Chris Philipp gave a summary of the process. Marty Lenss was asked and agreed to provide to the City of Fairfax documentation of their 50-year plan and opposition notices which he said were sent to Cedar Rapids concerning the other development currently happening in the Big Cedar Industrial Center. Motioned by Daly, seconded by Wainright to approve RESOLUTION 2025-106, A RESOLUTION APPROVING A THIRD CHANGE ORDER AND PURCHASE ORDER FOR THE PURCHASE OF A FIRE TRUCK FROM DANKO EMERGENCY EQUIPMENT FOR THE CITY OF FAIRFAX FIRE DEPARTMENT with a typo correction as noted for the change order amount of $1,500.00. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-106 duly adopted. Motioned by Volk, seconded by Wainright to approve RESOLUTION 2025-107, A RESOLUTION FOR THE AWARD OF THE 2025 FIRE STATION ADDITION PROJECT. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-107 duly adopted. Motioned by Daly, seconded by Volk to approve RESOLUTION 2025-108, A RESOLUTION APPROVING THE AGREEMENT FROM EASTERN IOWA BUILDING, INC. FOR THE CONSTRUCTION OF THE 2025 FIRE STATION BUILDING ADDITION. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-108 duly adopted. Chris Philipp was hired as Fairfax’s City Administrator on Monday, August 11. Discussion was held about an employment contract. Initially Chris did not think it was needed, but he requested the possibility of an employment contract be discussed after 90 days. Training was discussed. Motioned by Daly, seconded by Volk to revisit the topic of an employment contract for the city administrator after 90 days and to have Chris complete HR and leadership training within six months. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Discussion was held with representatives from South Slope about their request to be allowed to establish a South Slope five-foot utility easement on City property coming off Driftwood Lane. More capacity is needed in their lines to service this area and the easement would avoid disturbing residential properties to accomplish this. Motioned by Daly, second by Nurre to allow South Slope to establish the requested easement for no costs. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Absent: Wozniak. Motion carried. South Slope will have the required documents drafted. Joe Kell requested the Sons of the American Legion be allowed to run the concession stand during the Leon Evan’s Cruise-In on October 11 as in past years. Motioned by Wainwright, seconded by Daly to allow the Sons of the American Legion to run the concession stand during the Leon Evan’s Cruise-In on October 11, 2025. Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Absent: Wozniak. Motion carried. Motioned by Nurre, seconded by Daly to approve RESOLUTION 2025-109, A RESOLUTION APPROVING AN IDOT APPLICATION AND AGREEMENT FOR USE OF HIGHWAY RIGHT-OF-WAY FOR UTILITIES ACCOMMODATION FOR MIDWEST UNDERGROUND. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-109 duly adopted. Motioned by Nurre, seconded by Daly to approve RESOLUTION 2025-110, A RESOLUTION APPROVING AN IDOT APPLICATION AND AGREEMENT FOR USE OF HIGHWAY RIGHT-OF-WAY FOR UTILITIES ACCOMMODATION FOR ERVIN CABLE. Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Wozniak was absent. Motion carried. Mayor Beer declared RESOLUTION 2025-110 duly adopted. Chris Philipp requested Eric Von Sprecken be appointed as an assistant to the Building Administrator. Motioned by Nurre, seconded by Daly to appoint Scott Sellner to the Fairfax Planning and Zoning Commission to fill a vacancy until the end of the term on December 31, 2027.
