CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
October 14, 2025
A regular meeting of the Fairfax City Council was held October 14, 2025. Mayor Beer
called the meeting to order at 6:00 PM. Council members present: Tom Nurre, Mike Daly, Dan
Wozniak, Nick Volk, and Marianne Wainwright.
Motioned by Wozniak, seconded by Nurre to approve the consent agenda. Ayes: Nurre,
Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Colonel – Chief Deputy of the Linn County Sheriff’s Office Doug Riniker discussed adding
Flock Safety License Plate Recognition Cameras in Fairfax. He stated these are not speed
cameras. The fee is what Flock charges. Flock is responsible for upgrades and replacements.
The information is saved for 30 days but can be longer if there is an on-going investigation. He
also presented the monthly list of calls.
Motioned by Daly, seconded by Wainwright to have the Linn County Sheriff’s Department
place four Flock Cameras in Fairfax for law enforcement purposes. Ayes: Nurre, Daly, Volk,
and Wainwright. Nays: Wozniak. Motion carried.
Marianne Wainwright asked their deputies to look for semi-trucks going through town on
Church Street. Mayor Beer let him know there have been under-aged drivers of golf carts and
ATV/UTV racing.
Tom Nurre asked about the effect of no city water available at a fire site. Fire Chief Sankot
stated this fact slowed down the initial attack. He stated he would never suggest areas in Fairfax
without city water hydrant access.
Mike Daly asked about the status of rental inspections. Eric Von Sprecken stated specifically
at the Railroad Apartments, no one is living in the condemned apartments and the owners need to
pull permits for the repairs, but they are not responding to attempts to contact them. The City
may need to get the attorney involved soon.
Mike Daly asked about the status of the sewer extension project at 6811 Williams Blvd.
Brian Merta gave an overview of the work and issues.
Mayor Beer opened the Public Hearing regarding Electric Franchise with ITC, Ordinance
#127, at 6:19 PM. No comments had been received at city hall. Jamie Toledo with ITC
discussed the Franchise Ordinance. She stated 99% of their easements are granted voluntarily
from property owners. They dispose of any vegetation they cut down. Mayor Beer closed the
hearing at 6:25 PM.

ORDINANCE 127, AN ORDINANCE GRANTING TO ITC MIDWEST LLC, A WHOLLY
OWNED SUBSIDIARY OF ITC HOLDINGS CORP., ITS SUCCESSORS AND ASSIGNS
(THE "COMPANY"), THE RIGHT AND FRANCHISE TO ACQUIRE, CONSTRUCT,
RECONSTRUCT, ERECT, MAINTAIN, OPERATE AND REMOVE IN THE CITY OF
FAIRFAX, LINN, COUNTY, IOWA, A TRANSMISSION SYSTEM FOR ELECTRIC
POWER AND THE RIGHT TO ERECT AND MAINTAIN THE NECESSARY POLES,
LINES, WIRES, CONDUITS AND OTHER APPLIANCES, EQUIPMENT AND
SUBSTATIONS FOR THE TRANSMISSION OF ELECTRIC CURRENT AND
TELECOMMUNICATIONS ALONG, UNDER AND UPON THE STREETS, AVENUES,

Motioned by Daly, seconded by Wanwright to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
127. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.

Mayor Beer opened the Public Hearing regarding adopting an updated Fairfax Code of
Ordinances and Fairfax Zoning Code at 6:27 PM. No comments have been received at City Hall.
The fully updated code will be available from our website. Only previously approved ordinances
will be included. Mayor Beer closed the public hearing at 6:28 PM.
Motioned by Daly, seconded by Wozniak to introduce and approve the first reading of
ORDINANCE 01, AN ORDINANCE ADOPTING THE EXISTING FAIRFAX CODE OF
ORDINANCES, FAIRFAX ZONING CODE, AND FAIRFAX ZONING MAP OF THE
CITY OF FAIRFAX, IOWA, AS THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2025, FAIRFAX ZONING CODE 2025, AND THE FAIRFAX ZONING
MAP, 2025. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None.
Motion carried.
Motioned by Daly, seconded by Nurre to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 01.
Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Daly, seconded by Volk to give final approval of ORDINANCE 01, AN
ORDINANCE ADOPTING THE EXISTING FAIRFAX CODE OF ORDINANCES,
FAIRFAX ZONING CODE, AND FAIRFAX ZONING MAP OF THE CITY OF
FAIRFAX, IOWA, AS THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX,
IOWA, 2025, FAIRFAX ZONING CODE 2025, AND THE FAIRFAX ZONING MAP,
2025. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.
Discussion was held about information discussed during the Citizen Information Meetings
earlier in October. Jeff Hintz, one of the meeting organizers, thanked everyone for their help and
input and discussed the results of the emails after the meetings. Amy Stauffer-Heggebo, the
other organizer, had a statement submitted in the packet. Many area residents gave statements in
person.
Motioned by Daly, seconded by Volk to table ORDINANCE 123, AN ORDINANCE
AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF
FAIRFAX, IOWA, BY AMENDING SECTION 1.07.I.C. SPECIAL EXCEPTIONS for
now. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Dan
Wozniak then changed his vote to Nay. The motion was still carried.
Tom Nurre and Marianne Wainwright gave a statement against The Cedar Rapids Airport
placing a runway closer to Fairfax.
Motioned by Nurre, seconded by Daly to approve RESOLUTION 2025-127, A
RESOLUTION OBJECTING TO ANY FUTURE RUNWAY EXPANSION NORTH OF
WRIGHT BROTHERS BOULEVARD OR ANY RESISTANCE TO FUTURE LAND USE
POLICIES OF THE CITY OF FAIRFAX. Roll call vote: Ayes: Nurre, Daly, Volk, and
Wainwright. Nays: Wozniak. Motion carried. Mayor Beer declared RESOLUTION 2025-127
duly adopted.

RESOLUTION TO APPROVE THE PLANS AND SPECIFICATIONS FOR THE
BRIDGE REPLACEMENT – CCS PROJECT ON FM E-66 OVER OSCAR CREEK IN
THE CITY OF FAIRFAX, IOWA; IOWA DOT PROJECT NO. BRM-2462(602)--8N-57.
Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried. Mayor Beer declared RESOLUTION 2025-128 duly adopted.

RESOLUTION TO SET A TIME AND DATE FOR A PUBLIC HEARING FOR THE
PLANS AND SPECIFICATIONS FOR THE BRIDGE REPLACEMENT – CCS
PROJECT ON FM E-66 OVER OSCAR CREEK IN THE CITY OF FAIRFAX, IOWA;
IOWA DOT PROJECT NO. BRM-2462(602)--8N-57. Roll call vote: Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2025-129 duly adopted.
Brian Merta and Shane Wicks gave an update about the Well #4 Project.
Motioned by Volk seconded by Daly to approve RESOLUTION 2025-130, A
RESOLUTION TO APPROVE CHANGE ORDER NO. 4 FROM SCHRADER GRADING
AND EXCAVATING CO. FOR THE WATER SUPPLY WELL NO. 4 IMPROVEMENTS
PROJECT. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None.
Motion carried. Mayor Beer declared RESOLUTION 2025-130 duly adopted.
Shane Wicks gave an update about the 6811 Sewer Extension Project.
Motioned by Daly seconded by Nurre to approve RESOLUTION 2025-131, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM MIDWEST
UNDERGROUND CONTRACTORS, INC. FOR THE SANITARY SEWER EXTENSION
PROJECT TO 6811 WILLIAMS BLVD. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk,
and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2025-131
duly adopted.
Shane Wicks discussed the plans to run a temporary water main to the QTS Laydown
Campus.
Motioned by Daly, seconded by Nurre to approve the Water Main Extension Plan of
Improvements for the Water Main Extension to the QTS Temporary Construction Laydown
Campus Project. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Wainwright seconded by Volk to approve RESOLUTION 2025-132, A
RESOLUTION APPROVING THE WATER MAIN FACILITIES EASEMENT ON A
PORTION OF THE LOGISTICS PARK CEDAR RAPIDS, LLC PROPERTY LOCATED

Realignment & Reconstruction Project.

Motioned by Volk, seconded by Daly to proceed with the required work on the lot purchased
for the library project which includes labor, concrete removal, millings, and sidewalk, for an
estimate of $10,000. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Wainwright, seconded by Nurre to approve the quote of $9,585.00 from Pesek
Masonry for the welcome sign repair. Staff will do the landscaping. Ayes: Nurre, Daly, Volk,
and Wainwright. Nays: Wozniak. Motion carried.
Motioned by Volk, seconded by Wainwright to approve the quote of $11,000 with trade-in
from Wades for a Toro Z Master 6000 Series mower. Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly seconded by Wainwright to approve RESOLUTION 2025-141, A
RESOLUTION APPROVING AN IDOT APPLICATION AND AGREEMENT TO
PERFORM WORK WITHIN STATE HIGHWAY RIGHT-OF-WAY. Roll call vote: Ayes:
Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer
declared RESOLUTION 2025-141 duly adopted.
Motioned by Daly, seconded by Nurre to hire Eric Von Sprecken as the Building Official
(Building Inspector/Zoning Administrator) beginning October 15, 2025, at $25.29 per hour with
certification increases to come as earned. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright.

Motioned by Nurre seconded by Wozniak to approve RESOLUTION 2025-142, A
RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY
EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Beer declared RESOLUTION 2025-142 duly adopted.

RESOLUTION TO APPROVE THE HIRING PROCESS POLICY. Roll call vote: Ayes:
Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer
declared RESOLUTION 2025-143 duly adopted.
Motioned by Daly, seconded by Wainwright to approve starting the hiring of a full-time
Public Works 1 employee as recommended. Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Nurre to appoint Amy Stauffer-Heggebo to the Parks
and Beautification Committee for a 3-year term ending December 31, 2028. Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
