CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
February 13, 2024
A regular meeting of the Fairfax City Council was held February 13, 2024. Mayor Beer
called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Dan
Wozniak, Nick Volk, and Marianne Wainwright. Mike Daly was absent.
Motioned by Wozniak, seconded by Wainwright to approve the consent agenda. Ayes:
Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Mayor Beer explained the department reports are in the packet, all following a standard
format. No questions were asked about the reports.
A Linn County Deputy Sheriff entered the meeting and reviewed their monthly report.
Mayor Beer introduced Mt. Vernon’s Mayor Tom Wieseler and Ely’s City Administrator
Eldy Miller. They discussed their city’s experience with having a city administrator on staff.
Communication, qualifications, salary, and responsibilities were reviewed. It was discussed that
our retired mayors and experienced clerk are helping our current staffing work. They are
covering many administrator responsibilities and others are not being done by anyone.
Motioned by Volk, seconded by Nurre to approve the quote from Prairie Road Builders for
the annual streets seal coat work. Ayes: Nurre, Wozniak, and Volk. Nays: None. Absent:
Daly. Abstain: Wainwright. Marianne Wainwright abstained because her employer, LL
Pelling, also submitted a quote. Motion carried.
Michael Gannon presented his Groundwater Modeling concerning water use in the Fairfax
area. It was suggested to send this report to the IDNR to keep on file and use when the Big
Cedar Industrial Park area submits an application for water usage.
Mayor Beer reviewed an outline for public hearings. Then she opened the public hearing
regarding the 2024 Water Main Extension Under UP Railroad Project at 6:58 PM. No comments
had been received at city hall nor were any given during the meeting. Mayor Beer closed the
public hearing at 7:00 PM.
Jon Larson with Hall and Hall Engineers reviewed the bids received. He is recommending
accepting the bid from Tschiggfrie Excavating for $339,830.60, which is above the engineer’s
estimate but still within the total budget amount.
Motioned by Wainwright, seconded by Wozniak to approve RESOLUTION 2024-09, A
RESOLUTION FOR THE AWARD OF THE 2024 WATER MAIN EXTENSION UNDER
UNION PACIFIC RAILROAD PROJECT. Roll call vote: Ayes: Nurre, Wozniak, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Beer declared
RESOLUTION 2024-09 duly adopted.
Jon Larson reviewed the additional work needed due to the Union Pacific Railroad’s process.
This causes Hall and Hall Engineers’ need to amend their services agreement.
Motioned by Nurre, seconded by Volk to approve RESOLUTION 2024-10, A
RESOLUTION AUTHORIZING AMENDMENT NO. 2 TO THE PROFESSIONAL
SERVICES AGREEMENT BETWEEN THE CITY OF FAIRFAX AND HALL & HALL
ENGINEERS, INC. Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays:
None. Absent: Daly. Motion carried. Mayor Beer declared RESOLUTION 2024-10 duly
adopted.
Mayor Beer opened the public hearing regarding the West Cemetery Road Bridge Project
options at 7:04 PM. Shane Wicks gave a presentation about the options of a 65’ foot bridge or
an 80’ bridge. Several residents asked questions about the project stressing impact on private
property, water flows, and bridge safety. Tom Nurre asked about the weight the new bridge
could handle and Marianne Wainwright discussed active water flows. Mayor Beer closed the
meeting at 8:11 PM.
Motioned by Wainwright, seconded by Volk to instruct the design of the bridge to continue
with the 65’ option. Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent:
Daly. Motion carried.
Mayor Beer opened the public hearing regarding revisions to the City of Fairfax Zoning
Code at 8:13 PM. Chris Philipp gave a presentation about proposed Ordinance 90 amending
1.05.B Definitions and 1.08.B Accessory Buildings and Structures in the Fairfax Zoning Code.
Then he also gave a presentation about proposed Ordinance 91 amending 1.07 in C2 Highway
Commercial and 1.07 in Light Industrial in the Fairfax Zoning Code. Jeff Christenson, the
chairman of the Fairfax Planning and Zoning Committee, gave input about their process and
thoughts. One resident had stopped at city hall and discussed the recommended changes to the
Light Industrial. City Council asked about input from the Fire Chief Mike Sankot, Knox Boxes,
size for garages, and construction restrictions for pole buildings. Mayor Beer closed the public
hearing at 8:33 PM.
Motioned by Wozniak, seconded by Nurre to introduce and approve the first reading of
ORDINANCE 90, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING TO
SECTION 1.05.B DEFINITIONS AND BY AMENDING SECTION 1.08.B ACCESSORY
BUILDINGS AND STRUCTURES. Roll call vote: Ayes: Nurre, Wozniak, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried.
Motioned by Nurre, seconded by Wainwright to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
90. Roll call vote: Ayes: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None.
Absent: Daly. Motion carried.
Motioned by Wainwright, seconded by Nurre to give final approval of ORDINANCE 90,
AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY ADDING TO SECTION 1.05.B DEFINITIONS
AND BY AMENDING SECTION 1.08.B ACCESSORY BUILDINGS AND
STRUCTURES. Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None.
Absent: Daly. Motion carried.

Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly.
Motion carried.

Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Mayor Beer opened the public hearing regarding revising the Future Land Use Map in the
City of Fairfax’s Comprehensive Plan at 8:38 PM. Chris Philipp gave a presentation about the
revisions. No comments had been received at city hall. Council discussed the drainage basin
area. Mayor Beer closed the public hearing at 8:42 PM.
Motioned by Nurre, seconded by Wainwright to approve RESOLUTION 2024-11, A
RESOLUTION TO ADOPT A REVISED FUTURE LAND USE MAP, AS PART OF THE
COMP PLAN, FOR THE CITY OF FAIRFAX, IOWA. Roll call vote: Ayes: Nurre,
Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Beer
declared RESOLUTION 2024-11 duly adopted.
Cynthia Stimson explained the proposed Alliant Electric Facilities Extension Agreement is
for the street lights along Lefebure Road. She is still discussing the total amount due with
Alliant but the amount will be under $35,000 (the budget was $130,000).
Motioned by Wainwright, seconded by Nurre to approve RESOLUTION 2024-12, A
RESOLUTION AUTHORIZING ENTERING INTO AN ELECTRIC FACILITIES
EXTENSION AGREEMENT WITH INTERSTATE POWER AND LIGHT COMPANY.
Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly.
Motion carried. Mayor Beer declared RESOLUTION 2024-12 duly adopted.
Motioned by Wainwright, seconded by Volk to give final approval of ORDINANCE 88, AN
ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2017, BY AMENDING THE OFFICIAL ZONING MAP AND
ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY
DESIGNATING THE ZONING CLASSIFICATION OF THE FOLLOWING PARCELS.
Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly.
Motion carried.
Chris Philipp reviewed the Commercial Sign Permit Application for the Waterworks. He is
recommending approval.
Motioned by Wainwright, seconded by Volk to approve a Commercial Sign Permit for 308
Vanderbilt Street from the John and Christina Zielke Trust. Ayes: Nurre, Wozniak, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried.
Chris Philipp discussed the plat of Prochaska’s First and Second Additions to Linn County,
Iowa. This is not in our future growth area. He is recommending approval.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2024-13, A
RESOLUTION APPROVING A PLAT. Roll call vote: Ayes: Nurre, Wozniak, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Beer declared
RESOLUTION 2024-13 duly adopted.
The hiring committee’s recommendation to hire Eric Von Sprecken as a full-time Public
Works I employee was reviewed.
Motioned by Wainwright, seconded by Volk to hire Eric Von Sprecken as a full-time Public
Works I employee for $22.50 an hour with a start date of February 14, 2024. Ayes: Nurre,
Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Motioned by Nurre, seconded by Wozniak to approve RESOLUTION 2024-14, A
RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY
EMPLOYEES. Roll call vote: Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None.
Absent: Daly. Motion carried. Mayor Beer declared RESOLUTION 2024-14 duly adopted.
Motioned by Volk, seconded by Wainwright to approve the Kluesner Construction quote of
$13,832.24 for crack sealing. Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None.
Absent: Daly. Motion carried.
Motioned by Wozniak, seconded by Volk to approve the Kluesner Construction quote for
street sweeping with Lynn Miller supervising how many hours and what areas to sweep. Ayes:
Nurre, Wozniak, and Volk. Nays: None. Absent: Daly. Abstain: Wainright. Marianne
Wainwright abstained because her employer, LL Pelling, also submitted a quote. Motion
carried.
Motioned by Nurre, seconded by Volk to approve RESOLUTION 2024-15, A
RESOLUTION TO APPROVE THE NEWSLETTER POLICY. Roll call vote: Ayes:
Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor
Beer declared RESOLUTION 2024-15 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2024-16, A
RESOLUTION ENTERING INTO A 28E AGREEMENT FOR BUILDING OFFICIAL
SERVICES WITH THE CITY OF PALO. Roll call vote: Ayes: Nurre, Wozniak, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Beer declared
RESOLUTION 2024-16 duly adopted.
A brief discussion was held about a website proposal.
Motioned by Wainwright, seconded by Nurre to approve RESOLUTION 2024-17, A
RESOLUTION UPDATING THE CITY OF FAIRFAX’S 125 PLAN. Roll call vote: Ayes:
Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor
Beer declared RESOLUTION 2024-17 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2024-18, A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING
CONCERNING A TAX STATEMENT SHOWING THE PROPOSED TAX LEVIES FOR
FISCAL YEAR 2024-2025 BUDGET. Roll call vote: Ayes: Nurre, Wozniak, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Beer declared
RESOLUTION 2024-18 duly adopted.
Mayor Beer appointed Dan Wozniak as the Fairfax City Council’s liaison to the Fairfax
Library Board of Trustees.
Shane Wicks discussed a revised CIP sheet. Cynthia Stimson reviewed revenue and expense
comparisons, available funds for projects, and a few FY25 budget spreadsheet highlights.
Dan Wozniak and Mayor Beer discussed their suggestion to go to two city council meetings
a month. Discussion was held about the length of meetings.
Dan Wozniak asked Joe Kell about park tournament registration fees. Joe informed him
player registration fees cover this expense.
Motioned by Volk, seconded by Nurre to approve the claims list dated February 13, 2024.
Ayes: Nurre, Wozniak, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Tom Arp clarified information the Council presented at the December city council meeting
regarding property ownership.
Mayor Beer discussed a Meet and Greet she has planned for 6:30 PM on Tuesday, March 26,
after the two special city council meetings. She has invited all of the volunteer boards and hopes
the City Council will stay to meet their members. She will have an invite to the public in the
next newsletter.
Mayor Beer gave an update about our meeting with the City of Cedar Rapids to draft a 28E
concerning annexation. The next meeting will be in Fairfax on February 23.
