CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
September 10, 2024
A regular meeting of the Fairfax City Council was held September 10, 2024. Mayor Beer
called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly,
Dan Wozniak, Nick Volk, and Marianne Wainwright.
Motioned by Wainwright, seconded by Daly, to approve the consent agenda. Ayes: Nurre,
Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
A Linn County Deputy Sheriff discussed the call report. He was aware of the notice for UTV
enforcement. He was the officer who contacted the resident about the camper on UP property. It
has been moved to the driveway.
Chris Philipp asked the Council if they want to send the problems at 115 Railroad Street to
the attorney for further action. The consensus was to proceed. Chris gave an update about the
28E Annexation Agreement with Cedar Rapids, their legal is reviewing the draft.
Mayor Beer gave an update about the letters of support regarding the UP-crossing grant.
Ashley Hinson’s offices said they don’t send letters of support for State of Iowa grant programs,
only federal. Iowa Senator for District 42 Charlie McClintock has replied he will send one.
Carter Bladwin, with Linn County Lifts, discussed their program. Rides are available to all
residents for $2.00 a ride scheduled 24 hours in advance.
Marketa Oliver was on the telephone and discussed the Administrator Recruitment Profile.
This will be placed on our website, the Iowa League of Cities’ ad page, and the International
City/County Management Association’s site. The timetable was discussed. A mid-December
employee start is planned.
Motioned by Daly, seconded by Wozniak to approve the City Administrator Recruitment
Profile. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Maggie Burger reviewed the 2024 Speer Financial TIF Report.
Council and staff discussed the request for an easement from the Fairfax American Legion.
No action will be taken at this time. Currently they can continue to cut across the city property.
They may want to ask about access through other adjoining property.
Joe Kell introduced Chase Harrison. The hiring committee is recommending Chase for the
full-time Parks and Recreation Assistant.
Motioned by Daly, seconded by Wozniak to hire Chase Harrison as the new full-time Parks
and Recreation Assistant at $20.00 an hour, starting September 23, 2024. Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Volk to approve RESOLUTION 2024-64, A
RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY
EMPLOYEES. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Beer declared RESOLUTION 2024-64 duly adopted.
Discussion was held about water system improvements. Design of Well #5 is all right at this
time, but the decision on the timing of the construction will be made later when we have more
information.
Motioned by Daly, seconded by Wozniak to approve RESOLUTION 2024-65, A
RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT
BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. Roll
call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Beer declared RESOLUTION 2024-65 duly adopted.
Motioned by Volk, seconded by Nurre to approve RESOLUTION 2024-66, A
RESOLUTION SETTING DATE FOR PUBLIC HEARING ON DESIGNATION OF THE
EXPANDED FAIRFAX URBAN RENEWAL AREA AND ON URBAN RENEWAL PLAN
AMENDMENT. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Beer declared RESOLUTION 2024-66 duly adopted.
Motioned by Nurre, seconded by Daly to approve a new Class C Retail Alcohol Liquor
License for Chilango’s Mexican Restaurant, LLC, at 513 Williams Blvd. Ayes: Nurre, Daly,
Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Beer opened the public hearing regarding the FY25 Budget Amendment #1 at 7:14
PM. The city clerk/treasurer reviewed the budget amendment report. She asked the council
about funding the City’s participation in the Heartland Heights culvert. LOST funds are to be
used. Mayor Beer closed the public hearing at 7:19 PM.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2024-67, A
RESOLUTION APPROVING THE CITY’S PROPOSED AMENDMENT #1 TO THE
FISCAL YEAR 2024-2025 BUDGET. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2024-67
duly adopted.
Mayor Beer opened the public hearing regarding a change in the Fairfax Zoning Code at 7:20
PM. Chris Philpp discussed the proposed change to establish where a shouse is allowed. The
P&Z recommended in Ag and 44RS Districts. The City Council asked for them to only be
allowed in the Ag District. Mayor Beer closed the hearing at 7:25 PM.
Motioned by Daly, seconded by Nurre to introduce and approve the first reading of
ORDINANCE 103, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING TO
SECTION 1.05.B, AND SECTION 1.07.A.A.3 OF THE FAIRFAX ZONING
ORDINANCE as amended to only allow a shouse in the Ag District. Roll call vote: Ayes:
Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Daly to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
103. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None.
Motion carried.
Motioned by Wainwright, seconded by Daly to give final approval of ORDINANCE 103,
AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY ADDING TO SECTION 1.05.B, AND SECTION
1.07.A.A.3 OF THE FAIRFAX ZONING ORDINANCE as amended to only allow a shouse
in the Ag District. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried.

ORDINANCE 92, AN ORDINANCE ADDING TO THE CODE OF ORDINANCES OF
THE CITY OF FAIRFAX, IOWA, 2017, BY ADDING PROVISIONS PERTAINING TO
RENTAL HOUSING REGULATIONS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Nurre, seconded by Volk to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 92.
Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Volk, seconded by Wainwright to give final approval of ORDINANCE 92, AN
ORDINANCE ADDING TO THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2017, BY ADDING PROVISIONS PERTAINING TO RENTAL
HOUSING REGULATIONS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Chris Philipp informed the Council Fairfax has about 131 rental units for inspections.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION 2024-68, A
RESOLUTION ESTABLISHING RENTAL HOUSING FEES. Roll call vote: Ayes: Nurre,
Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared
RESOLUTION 2024-68 duly adopted.
Motioned by Wainwright, seconded by Volk to introduce and approve the first reading of
ORDINANCE 100, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE CITY OF FAIRFAX, IOWA, 2017, BY AMENDING PROVISIONS PERTAINING
TO SIGN REGULATIONS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Nurre, seconded by Daly to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 100.
Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion
carried.

ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2017, BY AMENDING PROVISIONS PERTAINING TO SIGN
REGULATIONS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays:
None. Motion carried.

ORDINANCE 104, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE CITY OF FAIRFAX, IOWA, 2017, BY AMENDING PROVISIONS PERTAINING
TO TRANSIENT MERCHANTS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.

on for passage at two council meetings prior to this meeting with respect to ORDINANCE 104.

Motioned by Volk, seconded by Daly to give final approval of ORDINANCE 104, AN
ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2017, BY AMENDING PROVISIONS PERTAINING TO
TRANSIENT MERCHANTS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Volk to appoint Shawn Witham to the Planning and
Zoning Commission for a term ending December 31, 2027. Ayes: Nurre, Daly, Wozniak, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2024-69, A
RESOLUTION TO ENTER INTO AN AGREEMENT WITH OPN ARCHITECTS. Roll
call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried.
