HomeMy WebLinkAbout11-12-2024 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING November 12, 2024 A regular meeting of the Fairfax City Council was held November 12, 2024. Mayor Beer called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly, Dan Wozniak, Nick Volk, and Marianne Wainwright. Motioned by Nurre, seconded by Wainwright to approve the consent agenda. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp gave an update about the Annexation Agreement with Cedar Rapids. Dave McDowel discussed plans to sell lots along E Southview Road. The lots do not currently have water or sewer service. The water main is in front, but the sewer would need to be extended. The City Council directed Chris Philipp to not issue any building permits for these lots until more answers are known. This topic is to be on the December agenda. A Linn County Deputy Sheriff presented the list of calls. Discussion was held about the request from the IDOT and Iowa Snowdrifters to enter into an agreement with the IDOT. Rob with Iowa Snowdrifters talked about their club and trail grooming. Barb Conner discussed concerns about how the snow is placed and the speed of the snowmobiles. She was directed to contact Iowa Snowdrifters directly. Motioned by Daly, seconded by Nurre to approve RESOLUTION 2024-82, A RESOLUTION APPROVING AN APPLICATION AND AGREEMENT TO PERFORM WORK WITHIN STATE HIGHWAY RIGHT-OF-WAY FROM IOWA SNOWDRIFTERS. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2024-82 duly adopted. Motioned by Daly, seconded by Wozniak to approve RESOLUTION 2024-83, A RESOLUTION APPROVING THE PRELIMINARY PLAT AND DEVELOPMENT AGREEMENT FOR THE BIG CEDAR INDUSTRIAL CENTER IN TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2024-83 duly adopted. Motioned by Nurre, seconded by Volk to approve RESOLUTION 2024-84, A RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2024-84 duly adopted. Motioned by Daly, seconded by Wozniak to approve RESOLUTION 2024-85, A RESOLUTION APPROVING AN ECONOMIC DEVELOPMENT ASSISTANCE CONTRACT WITH CONVERGEN ENERGY IOWA, LLC, THE CITY OF FAIRFAX, AND THE IOWA ECONOMIC DEVELOPMENT AUTHORITY. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2024-85 duly adopted. Mayor Beer appointed Deb Mallie to the City of Fairfax Library Board of Trustees for a term ending July 1, 2026. Mayor Beer appointed Wayne Josefek to the City of Fairfax Library Board of Trustees as a Fairfax Resident Member at Large for a term ending July 1, 2028. Bruce Bolt and Kay Moyer discussed the Library’s Focus Group process. OPN will be at the December meeting to discuss building specifics. Details were again requested concerning the Vern Cerveny Estate bequest. Quotes for a new fire truck were reviewed. Fire Chief Sankot is recommending the quote from Danko. Motioned by Daly, seconded by Volk to accept the quote from Danko of $458,710 for a new 2,000-gallon pumper/tanker installed on a Freightliner ME 106 Plus Regular Cab Chassis, as per specifications. The chassis payment of approximately $118,000.00 will be due when the chassis is delivered to Danko next summer. The rest will be due when the truck is done approximately 400-485 calendar days after the Sales Agreement is received at Danko. Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Fire Chief Sankot discussed both adding an addition on to the current fire station and building a new station more in the middle of Fairfax. More information is to be presented. Chris Philipp discussed concerns the City has received about the Rental Inspection Program. Owners who have family living in the dwelling do not want to participate. Chris stated we are getting our landlord list with the addresses from those classified as renters from our utility billing software. Owners can put the utilities in the owners’ name and remove the renter’s information from our system. This will take that address out of the rental inspection program. Or, they can leave the billing as is and change the name of the owner on the property. Motioned by Daly, seconded by Nurre to introduce and approve the first reading of ORDINANCE 107, AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF FAIRFAX, IOWA, 2017 BY AMENDING CHAPTER 153 BUILDING CODE. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Wozniak to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 107. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Wozniak to give final approval of ORDINANCE 107, AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF FAIRFAX, IOWA, 2017 BY AMENDING CHAPTER 153 BUILDING CODE. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2024-89, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT INTEREST AND FEES DUE. Roll call vote: Ayes: Nurre, Daly, Wozniak, Volk, and Wainwright. Nays: None. Motion carried. Mayor Beer declared RESOLUTION 2024-89 duly adopted. The schedule for the city administrator candidates’ tour, Meet and Greet, and special city council meeting was discussed. There may be the need for a special city council meeting on November 19. The FY26 budget schedule was reviewed.
