Early in May, 1936 about 26 citizens of the village of Fairfax?
Iowa met in the American Legion Hall of Pekoary Post #572, Fairfax, Iowa
for the purpose of discussing the advisability and possibility of in-
corporating the town of Fairfax.
After a long friendly discussion upon the subject of incorporating,
and the possible benefits and/or disadvantages to an incorporated town.
such as Fairfax a vote was taken on whether or not an attempt should
be made to incorporate and the result was that 25 of the 25 citizens
were in favor of incorporating and one was nor--commital.
A committee consisting of James Yanecek, John 11Javr°a and john
L. Krall was appointed to consult with Wayne C. Boland, Attorney,
Cedar° Rapids, Iowa relative to preparing the necessary petition
to the HON. DISTRICT, COURT OF LINN COUN 'Y, 11OWA, which petition was
to be signed by the required number of qualified electors of the
proposed incorporation, asking said court to approve the incorporation
and appoint five co-missioners to hold an election. This petition
was signed by apps .x1imately 55 qualified electors and submitted to
the Court, together with photostatic copy of the official plat to
be embraced in said 'Town of Fairfax.
The court appointed C. J. Knickerbocker, VVm. Behle, Chas J.
Dvorak, John Wavra, and Frank J. luioynihan commissioners to hold an
election upon the question of w%ether or not to incorporate and to
do such other duties as prescribed by law.
The Comissi.oner<s filed proper notice of the election to be

held on Monday, July 20th, 1936 at the public school in the village
of Fairfax.

The election was held on the date scheduled at which there
were 129 ballots cast; 105 being in favor of and 24 opposed to
incorporating. The result of the election was submitted to
I
the court whereupon the court approved the incorporation and ordered
said commissioners to hold an election for the purpose of electing I

officers of the town.
On August 10, 1936 a caucus was weld in the American Legion
i
Hall at Fairfax for the purpose of nominating officers. Nominations
I
wade at this caucus at which John L. Krall acted as Chairman and Chas
J. Knickerbocker acted as Secretary were as follows:
For Mayor, Tm. Hehle; For Treasurer, E. F. Listebarger;
I
For As"essor, James Yanecek and for Councilmen; C. J. Knickerbocker,
Chas J. Dvorak, C. F. Heaton, John Wavra and Frank Moynihan.
The election, for the purpose of election of town officers'
was held Aug. 24, 1936 resulting in the election of the above
nominated officers, which officers were to serve until the next
regular election which is to bc: held in MarcJy 1938.
The Newly elected council met on the first Monday after
election, Aug. 31, 1926, at 12 o'clock noon to organize from which
