NOW, TO-WIT, this 4th day of January, A. D., 1937, at the hour
of 7:30 P. M., the council of the Town of Fairfax, Iowa met in regular
session, being the regular monthly meeting for the month of January,
1937, there being present Councilman Frank J. Moynihan, John Wavra
and Chas J. Dvorak and Mayor Behle.
On motion of councilman Wavra, seconded by councilman Dvorak
and unanimously carried, this meeting recessed until 7:30 P. M.,
January, 5th, 1937, and now, to-wit, this 5th day of January, 1937
at 7:30 P.M. this council reconvenes in regular session.
Councilmen present: C.J.Knickerbocker, John Wavra, Frank J.
Moynihan, Chas J. Dvorak and C. E. Heaton with Mayor Behle presiding.
The following resolution was offered by councilman C. E. Heaton
and seconded by councilman C. J. Knickerbocker, to-wit:
Be it resolved that :
WHEREAS, the town of Fairfax, Iowa is in need of funds to pay
current obligations and to pay a judgement against said town, entered
in the District Court of Linn County, Iowa, for the amount of Court
costs in the matter of the Incorporation of the said Town of Fairfax,
Iowa, and
WHEREAS, the said town will have expenditures to make for various
municipal functions in the near future, and
WHEREAS, the said town will have revenue comin in on or about
July 1, 1937 from the sale of two beer licenses and one cigarette
license, and
WHEREAS, it is necessary to pay existing obligations that re-
venue be raised at once, and
WHEREAS, under section 6223 of the Code of Iowa of 1937, re-
ading as follows:
ANTICIPATION OF REVENUE. Loans may be negotiated or warrants
issued by any municipal corporation in anticipation of its revenues
for the fiscal year in which such loans are negotiated or warrants
issued, but the aggregate amount of such loans and warrants shall not

such corporations for the fund er purpose
exceed the estimated revenue of suc co po p p
for which the taxes are to be collected for such fiscal year.
This council is empowered and authorized to borrow money and pledge
the credit of the said town of Fairfax in anticipation of said revenues.
NOW, THEREFORE, be it resolved that the said Town of Fairfax, and
this council borrow the sum of Two Hundred Fifty ($250.00) Dollars from
the Fairfax State Savings Bank of Fairfax, Iowa, for a period of not to
exceed one year, at a rate of discount not exceeding three (3) per cent,
and that a warrant issue to the Fairfax State Savings Bank in the sum
of Two hundred fifty ($25040) Dollars, and that E. F. Listebarger,
Treasurer, execute a warrant in the form attached to these minutes
of meeting attested to by the Clerk, J. L. Kral', in the sum of Two
hundred fifty ($250.00) Dollars, as evidence of the said loan; and
be it further resolved that from the proceeds of said loan, the said
Treasurer pay unto the Clerk of the District Court of Linn County,
Iowa, the sum of Forty five & 25/100 ($45.25) Dollars, in payment of the
Court costs in the matter of the incorporation of Fairfax; and be it
further resolved that said Treasurer pay unto W. C. Boland of Cedar
Rapids, Iowa the sum of Seventy six and 62/100 ($76.62) Dollars, for
moneys advanced by him in payment of various expenses incurred in the
matter of the incorporation of said town of Fairfax; and be it further
resolved that this motion and resolution be adopted as an ordinance of
said Town of Fairfax, and become a part of the permanent records of
said Town.
The foregoing motion and resolution was adopted and confirmed
by unanimous vote.
The following is a copy of the Tax Anticipation warranted
executed by E. F. Listebarger, Treasurer to the said Fairfax State
Savings Bank:
"Fairfax, Iowa Jan. 5, 1937
KNOW ALL MEN BY THESE PRESENTS, that the Town of Fairfax,
Iowa, is indebted unto the Fairfax State Savings Bank of
Fairfax, Iowa, in the sum of Two hundred fifty ($250.00)
Dollars, payable on the 10th day of July, 1937, upon pre-
sentation to the Treasurer of the Town of Fairfax, Iowa
from any funds in his hands belonging to the Town of
Fairfax, Iowa. This warrant issued under specific
authority and resolution adopted by the City Council of
the Town of Fairfax, Iowa, on January 5, 1937 ."

The minutes of the meeting of Nov. 2, 1936 were read and approved
and Clerk's notation of Dec. 7, 1936 was read.
On motion of councilman Frank Moynihan, seconded by councilman
John Wavra, and unanimously carried, the council fixed the poll tax
for the year 1937 at $3.00 for each male person between the ages of
21 years and 45 years, said poll tax to be collected by the Clerk of
the Town of Fairfax, Iowa who shall issue receipts for same.
On Motion of councilman C. J. Knickerbocker, seconded by council-
man Moynihan, and unanimously carried, the council fixed the dog
tax for the year 1937 at $1.00 for each male or spayed female and
$3.00 for each female, said dog tax to be collected by the clerk
who shall issue receipts for same.
On motion of councilman John Wavra, seconded by councilman
Moynihan, and unanimously carried, Wm. G. Zamastil was named
Town Marshall and street commissioner.
On motion of councilman C. J. Knickerbocker and seconded
by councilman Chas J. Dvorak the following bills were approved
and ordered paid:
Iowa Electric Light & Power Co. Street Light $3.32
Matt Parrott & Sons Co. for Supplies, books, etsc- - 25.23
On motion of councilman Heaton, seconded by councilman
C. J. Dvorak, and unanimously carried, the meeting adjourned.
