NOW-TO-WIM this 3rd day of January, A.D., 1938, at the hour of 7:30
P. M. the Council of the Town of Fairfax, Iowa met in regular session and in the
absence of Mayor Behle on motion duly made, seconded and carried C. E. Heaton
was named Temporary Chairman of the meeting.
Councilmen present were: 0. E. Heaton, John Wavra, Chas J. Dvorak
and C. J. Knickerbocker.
Councilman absent: Frank J. Moynihan.
The minutes of the proceeding meeting were read and approved.
The following resolution was offered by Councilman C. J. Knickerbocker
and seconded by Councilman, Chas J. Dvorak:
BE IT RESOLVED THAT: Whereas, the Town of Fairfax, Iowa is in need
of funds to pay current obligations, and .
WHEREAS, the said town will have revenue coming in during the coming
year from two beer licenses and one cigarette license and from taxes levied
during 1937, and
WHEREAS, under section 6223 of the Code of Iowa of 1937, reading
as follows:
ANTICIPATION OF REVENUE. Loans may be negotiated or warrants issued
by any municipal corporation in anticipation of its revenues for the fiscal
year in which such loans are negotiated or warrants issued, but the aggregate
amount of such loans and warrants shall not exceed the estimated revenue of
such corporations for the fund or purpose for which the taxes are to be
collected for such fiscal year.
This council is empowered and authorized to borrow money and pledge
the credit of the said Town of Fairfax in anticipation of said revenues.
NOW, THEREFORE, be it resolved that the said Town of Fairfax, and
this council, borrow the sum of Four hundred fifty($450.00) Dollars from the
Fairfax State Savings Bank of Fairfax, Iowa, for a period of not to exceed
one year, at a rate of discount not exceeding three (3) per cent, and that a
warrant issue to the Fairfax State Savings Bank in the sum of Four hundred
Fifty Dollars, and that E. F. Listebarger, Treasurer, execute a warrant in •
the form attached to these minutes of meeting attested to by the Clerk, J. L.
Krall, in the sum of Four hundred fifty dollars, as evidence of the said
loan; and be it further resolved that from the proceeds of said loan current
obligations of the Town of Fairfax be paid.
The foregoing motion and resolution was adopted and confirmed by
unanimous vote of the councilmen present.

The following is a cony of the Tax Anticipation warrant executed by
E. F. Listebarger, Treasurer to the said Fairfax State Savings Bank:
Fairfax, Iowa, January 4, 1938. $450.00
"KNOW ALL MEN BY THESE PRESENTS, that the Town of Fairfax, Iowa is in-
debted unto the Fairfax State Savings Bank of Fairfax, Iowa, in the sum of Four
hundred fifty ($450.00) payable on the 15th day of November, 1938, upon present&
tion to the Treasurer of the Town of Fairfax, Iowa from any funds in his hands
belonging to the Town of Fairfax, Iowa. This warrant issued under specific
authority and resolution adopted by the City Council of the Town of Fairfax,
Iowa, on January 3, 1938".

On motion of Chas J. Dvorak, Seconded by Councilman C. J. Knickerbocker
and unanimously carried the following bills were allowed and ordered paid:
Iowa Elec. Light & Power Co. Light for Town Hall - - - - $1.63

Fairfax Telephone Association, Tolls 1.53
WHEREAS, W. C. Boland, Attorney of Cedar Rapids, Iowa has performed
certain legal services in connection with the incorporation of the Town of
Fairfax, Linn County, Iowa; and
WHEREAS, the said W. C. Boland has presented a statement for his
services rendered in connection with said Town of Fairfax in the amount of
1570.00; and
WHEREAS, the said W. C. Boland had heretofore made a discount of
said amount in the sum of 1170.00; and
WHEREAS, the said W. C. Boland has made a further special discount
ii,gpowtimt on said statement in the sum of $250.00, leaving the net amount
of the statement 1150.00; and
WHEREAS, it is the opinion of this council that said services rendered
by the said W. C. Boland have been properly performed and completed and that
his agreement to accept $150.00 in full payment for services rendered to this
date is very satisfactory and very much appreciated
NOW, THEREFORE, be it resolved that the said claim of W. C. Boland
in the sum of t150.00 be and the same is hereby allowed and ordered paid
by warrant drawn on the general fund.
The above motion and resolution was unanamously adopted.

It was moved, seconded and unanamously carried that the amount
of ' 265.74 be paid Denniston Partridge Company in payment for the full
amount due to this date on the balance of material furnished for the Town
Hall.
