Behle, being absent, it was moved, seconded and carried to make Councilman, C. E. Heaton, chairman of the meeting. The meeting was called to order at 7 : 3 D P. M. and the councilmen present were, C. E. Heaton, .Vim. E. Dvorak, Chas J . Dvorak and C. J. Knickerbocker. Councilman, Frank Moynihan, being absent. The minutes of the preceeding meeting were read and approved. A bill from the Concrete Materials & Construction Co . for $227 . 11 for gravel furnished on Losey Road was read and a bill from ffm. F. Zamastil for draying to and including Jan. 7, 1941 for $10. 25 was read. It -was moved by Councilman, C. J. Knickerbocker, seconded by Councilman Iffm. E. Dvorak., and unanimously carried that the bills as read be allowed and paid. The following resolution was offered by councilman, Chas J . Dvorak, and seconded by Councilman C. J. Knickerbocker, to-wit- Be it Resolved that: Whereas, the town of Fairfax, Iowa is in need of funds to pay outstanding refused and unpaid warrants and to pay certain fixed expenditures in the near future, and KHEREAS, the said town will have revenue coming in during the year of 1941 from taxes levied and from cigarette and beer licenses, and WHEREAS, it is necessary to pay existing outstanding warrants and obligations that revenue be raised at once, and WHEREAS, under section 6223 of the Code of Iowa of 1937 , reading as follows : ANTICIPATION OF REVENUE. Loans may be negotiated or warrants issued by any municipal corporation in anticipation of its revenues for the fiscal year in which such loans are negotiated or warrants issued the the aggregate amount of such loans and warrants shall not exceed 'the extimated revenue of such corporations for the fund or purpose for which the taxes are to be collected for such fiscal year. This council is empowered and aut -orized to borrow money and pledge the credit of the said town of Fairfax in anticipation of said revenues . NOW, THEREFORE, be it resolved that the said Town of Fairfax, and this council borrow the sum of One thousand 01, 000.00) Dollars from the Fairfax State Savings Bank of Fairfax, Iowa, for a period of not to exceed eleven months, at a rate of discount not to exceed three ( b) per cent, and that a warrant issue to the Fairfax State Savings Bank in the sum of One thousand ($1,000.00) Dollars, and that E. F. Listebarger, treasurer, execute a -warrant in the form attached to these minutes of meeting, attested to by t1ie Clerk, J. L. Krall, in the sum of One thousand Dollars, as evidenced kXXXXt&X1aXXX Jan. 6, 1941 continued of the said loan; and be it further resolved that the proceeds of said loan be deposited to the credit of E. F. Listebarger, Treasurer of the Town of Fairfax, Iowq with which to pay outstaDding warrants and future obligations of said torn; and be it further resolved that tads motion and resolution be adopted as an ordinance of said Town of Fairfax and become a. part of the permanent records of said town. The foregoing motion and resolution was adopted and confirrledy by unanimous vote. The following is a copy of the Tax Anticipation warrant executed by E. F. Listebarger, Treas-arer of Fairfax, Ia . !, A written complaint filed with the clerk by Frank fdoynihan regarding a neuisance caused from several large hogs kept in a small pen by one Harold Brecht adjoining the property of Frank Moynihan was read and due to the absence of MUor Behle it was moved., seconded and carried to file the complaint for action at the next meeting. It was moved by Councilman, C. J. Knickerbocker, seconded by I Councilman Chas J . Dvorak and unanimous-1'r carried to tax each male and each spayed female dog $1 . 00 and each female $3.00 :f'or the year 1941 and that arrangements be wade, if possible, with assessor, James "anecek, to collect said tax at the time of making the assessment and to allow Jazzes Yanecek the usual ten pmts "x for each fee collected.
