HomeMy WebLinkAbout05/14/1942 Council Minutes f May 14, 1942. �. Special meeting of the Town Council of the Town of Fairfax, Iovtaa held this 14th day of May, 1942. The meeting was celled to order at 8 P. M. and the council- men present were- 0. E. Heaton, Wm- E. Dvorak, Frank Loynihan, Chas J . Dvorak and C. J. Knickerbocker. The minutes of the preceeding meeting were read and approved as read. PROPOSED RESOLUTION OF NECESSITY A RESOLUTION decl' a-rrinE the necessity of improving certain streets, as hereinafter described, by constructing a. liquid asphalt and gravel surfacing upon said streets and assessing 'he entire costs thereof against the adjacent property. DE IT RESOLVED by the Town Council of the Incorporated Torn of Fairfax, Lowe .on. its own motion-, That it is deemed advisable and necessary to build, construct and put in place certain improvements, as hereinafter described, in, upon and along the following described streets in said Town: Description: Lo sey Road from the junction with HQhway No . 149 to Vanderbilt Street, Main Street from the east line of pavement on Hi, huwJay No .. 149 to the east line of Reynolds Street , Vanderbilt Street for the entire length of said street, Park Street from the south line of Right of way and station grounds of C . A. N . W. R. R. Co . to the south line of Church Street,, Reynolds Street from the North line of Rain Street to the south line of Church Street., Church Street from the east lire of pavement on Highway Do .. 149 to the east Corporation lire . I , Streets in the above schedule are to be improved in the following runner and with the folloqinz materials ; Liquid asphalt 1 of from sixty:- to eighty percent asphalt content to be applies: on the beaten driveway of each street, ,same to be applied hot, with modern motorized pressu e distributor: immediately- afterward to be covered vith aggregate (crushed rock, gravel or sand) applied With a mechanical spreader t the rate of €ir�,;% pounds per square yard. The proposed plot and ,schedule of assessments showing the streets to be improved, the width of such improvement, and estimate of the cost of said proposed improvement , stating same for the .tv-see of construction aid the kind of later ._.1s to be used, and in each case the amount thereof which is estimated to be apsesoed against, each lot , part of lot or parcel of ground on account of said proposed construction ction i s now on file for public examination in the office of the Town Clerk. i May 14, 1042 core M.ed 87 BE IT FURTHER RESOMED that for the purpose of complying with Section 599 of the W39 Code ©f Iowa, that it be sho of record that said improvement was not petitioned for but that said proposed improvement was initiated by the Council of the Town of' Fairfkx, Iowa on its own motion. BE IT FURTHER RESOMD that the foregoing improvements are hereby proponed to be made and constructed as hereinbefore set forth and that this Resolution of Necessity, except this yara- graph, is hereby set down for further and final consideration and determiration at a meeting of the Town Cooncil to be held in the Fairfax State Savings Bank in said Town clothe 2nd day of June, 1942, at S : oo o ' clock P. M. , and that the Town Clerk be and he hereby is instructed to cause notice of the pendency of said re- solution and of the time and place when and where said vesolution will be considered for adoption and objections to some and to the construction of said groposed improvement be heard, to be given by posting notice in three public places in the Danner and for the time provided by law. BE IT FURTHER RES01VED That unless the property owners appear at said time , to-wit: June 2, 1942, at 8: 00 o ' clock P . b. , being the time fixed for the final consideration of said res- olution of necessity , and that unless they have on file with the Town Clerk of the Town of Fairfax, !own, objections to the proposed construction contemplated by said resolution or to the aDount of the assessments therefore, they shall be deemed to have waived all rights to object thereto . Councilman G. J. Knickerbocker introduced the foregoing resolution and moved that it be taken up for final consideration at the time and place fixed in said revolution and that notice be given accordingly. Councilman Wm. F. Dvorak seconded the action . The question being upon the adoption of the motion the roll was called and the following vote recorded: Ayes : G.J.Knickerbocker, M. F. Dvorak, Chas J . Dvorak, Frank Moynihan and C . E. Heaton. Nays : None Thereupon the MLyor declared the motion to be unanimously carried . There being no further business to come before the meetinL Councilman C. E.
