HomeMy WebLinkAbout09/05/1947 Council Minutes 160 Sept. 5, 1947 Special meeting of the Town Council of the Town of Fairfax, Iowa held this 5th day of September, 1947. The meeting was called to order at 8 P. M. by Mayor, John Lefebure. Councilmen present: Chas A. Elson, Frank L. Barta, Chas J. Dvorak and John E. Murphy. Councilman absent: Chas J. Knickerbocker Who is in Alaska. max The minutes of the preceeding meeting were read and approved. The following ordinance on Disorderly Conduct was presented by Councilman, Chas J. Dvorak: DISORDERLY CONDUCT Ordinance # 10 If any person, within the Corporate limits of this town, conducts himself in a lewd, indecent or immoral way or engages with another person or persons in any boisterous, offensive, or disorderly conduct which is shocking or degrading to the public morals and decency, he shall be guilty of Disorderly Conduct. PENALTY: N Any person, firm or corporation who is convicd of any offense defined by this ordinance, or any person, firm or corporation violating or failing to comply with any of the provisions of this \ V ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding One Hundred ($100. 00) it Dollars or imprisoned for a term not exceeding thirty ( 30) Days. It was moved by Charles J. Dvorak, seconded by John E. Murphy and unanimously carried that the foregoing ordinance on Disorderly �, Conduct be adopted. It was moved by Frank L. Barta, Seconded by Chas A. Elson and unanimously carried that the second and third readings of the ‘ foregoing ordinance on Disorderly Conduct be dispensed with and the Ordinance be adopted as of this date to be in full force and effect upon publication as provided by statute. The following Ordinance on Disturbing the Peace was presented by councilman Chas A. Elson: DISTURBING THE PEACE Ordinance # 11 If any person within the Corporate limits of this Town disturb the Public Peace and quiet of others by violent, tumultuous, offensive or obstreperous conduct, . or by loud or unusual noises, or by blasphemous, obscense or offensive language, he shall be guilty of Disturbing the Peace. rA Minutes of Sept. 5, 1947 continued 1'l/ PENALTY: I\ Any person, firm or corporation who is convicted of any offense defined by this ordinance, or any person, firm or cor- tN poration violating or failing to comply with any of the provisions of this ordinance shall be guilty of a misdemeanor and upon con- viction thereof shall be fined in any sum not exceeding One Hundred .j ($100.00) Dollars or imprisoned for a term not exceeding thirty if ( 30) days. Elson and B^ unanimously carried that the second and third readings of the foregoing ordinance on Disturbing the Peace be dispensed with and the Ordinance be adopted as of this date to be in full force and effect upon phblication as provided by statute. The following Ordinance on Fighting was presented by Councilman Frank L. Barta: FIGHTING Ordinance # 12 If any person within the Corporate limits of this Town engages in a fight with another or assaults, strikes, or attempts to assault or strike, or invites or defies another person to fight or quarrel, he shall be guilty of Disturbing the Peace. PENALTY: Any person, firm or corporation who is convictdd of any offense defined by this ordinance, or any person, firm or cor- poration violating or failing to comply with any of the provisions I of this ordinance shall be guilty of a misdemeanor and upon con- viction thereof shall be fined in any sum not exceeding One Hundred ( $100.00) Dollars or imprisoned for a term not exceeding k\\Ni thirty ( 30) days. It was moved by Frank L. Barta seconded by Chas J. Dvorak and Y � Y unanimously carried that the foregoing ordinance on Fighting be adopted. It was moved by Chas A. Elson, seconded by Frank L. Barta and unanimously carried that the second and third readings of the foregoing ordinance on Fighting be dispensed with and the Ordinance be adpoted as of this date to be infull force and q \ effect upon publication as provided by statute. Minutes of Sept. 5, 1947 continued. /L?' The following Ordinance on Drunkenness was presented by Councilman John E. Murphy: DRUNKENNESS Ordinance # 13 If any person within the Corporate limits of this town becomes drunk or intoxicated, or is found in a state of intoxi- cation, he shall be guilty of Drunkenness. PENALTY: Any person, firm, or corporation who is convicted of any V offense defined by this ordinance, or any person, firm or cor- poration violating or failing to comply with any of the provision s4 of this ordinance shall be guilty of a misdemeanor and upon con- giction thereof shall be fined in any sum not exceeding One Hundred ($100.00) Dollars, or imprisoned for a term not exceeding thirty ( 30) days. It was moved by Chas A. Elson, Seconded by John E. Murphy and unanimously carried that the foregoing ordinance on Drunkenness q be adopted. It was moved by Chas A. Elson, seconded by Frank L. Barta and unanimously carried that the second and third readings of the foregoing ordinance on Drunkenness be dispensed with and the Ordinance be adopted as of this date to be infull force and effect upon publication as provided by Statute.
