October 6, 1947
Regular meeting of the Town Council of the Town of Fairfax,
Iowa held this 6th day of October, 1947.
The meeting was called to order at 8 P. M. by Mayor, John
Lefebure.
Councilmen Present: Chas A. Elson, Frank L. Barta, Chas J .
Dvorak and John F. Murphy .
Councilman Absent: C. J. Knickerbocker.
The minutes of the preceeding meeting were read and
approved.
A bill for $10.00 in payment of the Town Marshal ' s bond which
bond will expire Oct. 26, 1947 was read and it was moved,
seconded and unanimously carried that the bill be paid.
The following Curfew Ordinance was introduced by Councilman
Chas J. Dvorak:
ORDINANCE No . 14
AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE AGES
OF EIGHTEEN (18) YEARS IN PUBLIC STREETS AND OTHER PLACES BE-
TWEEN CERTAIN OURS, DEFINING DUTIES OF PARENTS OR OTHERS IN
CARE OF MINORS, PROVIDING FOR ARREST AND PENALTIES FOR VIOLA-
TIONS THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF FAIRFAX,
IOWA:
Section 1. LOITERING OF MINORS PROHIBITED.
It shall be unlawful for any minor under the age
\ ■ of of eighteen (18) years to loiter, idle, wander, stroll, or
\ play in or upon the public streets, highways , roads, alleys ,
parks, playgrounds, or other public grounds, public places
and public buildings, places of amusement and entertainment,
\ vacant lots or other unsupervised places, between the hours
of ten o ' clock P. M. and five o ' clock A.M. of the following
day, central standard time; provided, however, that the pro-
visions of this Section do not apply to a minor accompanied
by his or her parent, guardian, or other adult person having
the care and custody of the minor, or where the minor is
upon an emergency errand or legitimate business directed in
writing, dated and signed by his or her parent, guardian or
other adult person having the care and custody of the minor.

Each violation of the provisions of this Section
shall constitute a separate offense.

Section 2. RESPONSIBILITY OF PARENTS.
It shall be unlawful for the parents, guardian, or other
adult person having the care and custody of a minor under the
age of eighteen (18) years to knowingly permit such minor to
loiter, idle, wander, stroll, or play in or upon the public
streets, highways, roads, alleys, parks, playgounds, or other
public grounds, public places and public buildings, places of
amusement and entertainment, vacant lots or other unsupervised
places, between the hours of ten P. M. and five A. M. of the
following day, central time provided, however, that the pro-
visions of this Section do not apply when the minor is acc-
ompanied by his or her parent, guardian, or other adult nerson
having the care and custody of the minor, or where the minor
is upon an emergency errand or legitimate business directed in
writing, dated and signed by his or her parent, guardian, o$
other adult person having the care and custody of the minor.
Each violation of the provisions of this Section shall
constitute a separate offense.
Section 3. PENALTIES.
Any parent, guardian, or other adult person having the
care and custody of a minor violating Section 2 shall be fined
not less than $1.00 nor more than $100.00, or confined in Jail
not more than thirty ( 30) days, or punished by both said fine
and imprisonment for each offense.
Section 4. Separability of Provisions.
It is the intention of the Town Council that each separ-
ate ovovision of this Ordinance shall be deemed independent of
all other provisions herein, and it is furhter the intention
of the Town Council that if any provisions of this Ordinance be
declared invalid, all other provisions thereof shall remain
valid and enforceable.
It was moved by councilman Frank L. Barta, seconded by
councilman John E. aurphy, and unanimously carried that the
foregiong Ordinance No . 14 as read be adopted.
It was moved by Councilman Chas J. Dvorak, seconded by
Councilman Chas A. Elson and unanimously carried that the second
and third readings of the foregoing ordinance No. 14 on Curfew
be dispensed with and the ordinance be adopted as of this date
to be in full force and effect upon publication as provided
by statute.
Councilman Chas A. Elson introduced the following or-
dinance on Reckless Driving.
ORDINANCE No. 15
AN ORDINANCE ON RECLKESS DRIVING AND PROVIDING PENALTIES FOR
VIOLATION.

Sec. 1. RECKLESS DRIVING:
Any person who drives any vehicle in such manner as to
indicate either a willful or wanton disregard for the safety
of persons or property within the corporate limits of the
town of Fairfax, Iowa is guilty of reckless driving.
Sec. 2. PUNISHMtNT
Every person convicted of reckless driving within the
corporate limits of the Town of Fairfax, Iowa shall he pun-
ised upon conviction by imprisonment for a period of not
more than thirty ( 30) days, or by a fine of nota less than

\ It was moved by councilman Chas A. Elson, Seconded
by coUncilman Frank L. Barta and unanimously carried that
the foregoing ordinance on Reckless Driving as read be and
is hereby adopted.
It was moved by Councilman John E. Murphy, seconded
by councilman Chas J. Dvorak and unanimously carried that
the second and third readings of the foregoing ordinance on
reckless driving as read be xxdxxxxlmaxtx dispensed with
and the Ordinance be adopted as of this date to be in "ull
force and effect upon publication as provided for by
statute.
The following resolution was introduced by unanimous
approval of all Councilmen:
RESOLVED: That the annual permit fee for all Class
B. beer permits issued from and after this date be One
hundred fifty ( $150.00) Dollars.
It was moved by Councilman Chas J. Dvorak, seconded
by councilman Frank L. Barta and unanimously carried that
the resolution providing for an annual fee of $150.00 for
all class B. peer permits be adopted.
There being no further business to come before the
meeting it was moved, seconded and carried to adjourn.
