Regular meeting of the Town Council of the Town of
Fairfax, Iowa held this 5th day of December, 1956.
Meeting called to order at 7®30 P . M. by Mayor, Raymond
D. Mizner.
Councilmen present: Chas J. Dvorak, Ralph H. Emanuel,
F. Keith Listebarger and Leonard J. Yanecek.
Councilman absent•. Howard V. Steinmetz.
The minutes of the preceeding meeting were read, and
approved.
The treasurer' s report was read and approved.
Hills as represented by warrants No. 454 to No. 457,
both inclusive, were read and it was moored: seconded and carried
that all of same be approveds including the warrants as drawn.
Albert J. Stallm.an was presented and made oral objections
to the operation of the Concrete Materials and Construction
Company Quarry and requesting that proper action be taken to
control the operations and to prevent operations any closer
to the properties located to the west of the present operations.
It was moved by Ralph Emanuel., seconded by F. Keith
Listebarger and unanimously carried thAt the Clerk mail a
notice to the Concrete Materials and Construction Compare and
a c py of same to C. J. Knickerbocker, owner of the land upon
which the quarry is located., that operation of the quarry
shall not operate any .father west than the present point
at which operations have been carried on and to so conduct
the operations at the quarry so as not to endanger lives of
residents in the Uici.:nity and so as not to damage the properties
of residents In the Vicinity if they are to be permitted to
continue operations within the limits of the Town of Fairfax.
An application for annexation to the Town of Fairfax,ax, Iowa
signed by owners of the land described In said application, a
copy of which is hereto attached and made a part of these
minutes, which land adjoints the presont town limits was
presented..
A Resolution Annexing the Real. Estate described in the
application and also described in said resolution was presented,.
A copy of said resolution being attached hereto and being glade
a part of these minutes, and it was Moved by Ralph Emanuel,
Seconded. by F. Keith Listebarger, and unanimously carried
that the Resolution be adopted and the Mayor and Town Clerk
certify same to the Linn County Recorder.
There being no further business to come before the
meeting it was moved, seconded and carried to adjourn.
