Special meletinm of the Town Council of the Town
of Fairfax, Iowa held. this 28th day of December, 1956
The meeti.ng was called to order at 7 P. M. by
Mayor, Raymond D. Mizner®
Councilmen present: Ralph Emanuel, Keith Lei.stebarger
and Lennard J. Yanecdk.
Councilmen absent: Chas J. Dvorak and Howard Steinmetz
The nintes of the preceeding meeting were read
and approved.
The report of the planning and zoning commission
On the application for rezoning all of the SW-;:T' of the
NEI of sec . 9, Twp. 82 North., Range 8,, except the north
2 rods thereof, and except that land lying southeasterly
of public highway -#149,, Linn. County, Iowa, recommending
that said property be given Commerclal Zoning was presented
and considered.
It was moved by Ralph Emanuel, seconded by F. Keith
Lai.stebarger, and unanimously carried that as recommended
in the planning d. zoning commission's report that all
of said property �sr-ied Cos erc al, that a special
meeting of the Town council be held on the 23rd day of
January, 1957 at 7:3D F- M. and that the Town Clerk have
proper legal notice printed in the Cedar Rapids, Iowa
Gazette of said special meeting®
Bills as paid by warrants No. to No- 494, both
inclusive, were read and it was roved., seconded and
carried that said bills and the Issuance of said warrants
in payment of same be and are hereby approved.
The treasurer' s report was read and it was moved-,
seconded and carried tht same be approved®
The following resolution was offered by F. Keith
Listebarger and seconded by Leonard J. anecekt
BY. IT: RESOLVED D THAT: WHEREAS, the town of Fairfax
Iowa is in need of funds to pay current obligations, and
WHEREAS9 the said town will time fevenue coming in
during the coming year from to e , etc. , and
WHEREAS! under the Code of Iowa reading as follows.
ANTICIPATION OF REVENUE. Loans may be negotiated or
warrants issued by any municipal corporation in anticipation
of its revenues for the fiscal yee.r in which such lows
are negotiated,, or warrants issued., but the aggregate
amount of such loans and warrants shall not exceed the
estimated revenue such corporation for the fund or purpose
for which the taxes are to be collected for such
fiscal year®

This council is empowered and authorized to borrow
money and pledge the credit of the said 'Town of Fairfax
in anticipation of said revenues.

NOW, THEREFORE, be it resolved. that the said Town
of Fairfax, and this council, borrow the sum of One
Thousand. Five Hundred & No/10O ($1,500.00) Dollars from the
Fairfax State Savings fiat. of Fairfax, Iowa, for a period of
not to exceed, one year, at a rate of discount not exceeding
five (5) per cent, and that a warrant issue to the Fairfax
State Savings Bank in the sum of One thousand five hundred
NoI1O0 Dollars, and that Edna DeLany, Treasurer, execute
a w,9rrant in the form attached to these minutes of meeting
attested ti bt the 0lerk, J. L. Kra.11, in the sum of
One thousand. Fire Hundred and Igo/100 Dollars, as evidence
of the said loan; and be it further resolved that from
the proceeds of said. loan current obligations of the
Torn of Fairfax be paid.
The foregoing motion and resolution was adopted and
confirmed by unanimous vote of the council present,
The following is a copy of the Tax Anticipation

Fairfax, Iowa, December 29, 1956 $19500.00
KNOW ALL MEN BY THESE PRESENTS, that the Town of
Fairfax, Iowa is indebted unto the Fairfax State Savings Bank
of Fairfax, Iowa, in the sum of One thousand five hundred
and No/100 Dollars payable on the 29th day of December, 1957
upon presentation to the Treasurer of the Town of Fairfax, To ra.
from any funds in her hands belonging to the Town of Fairfax,
Iowa. This warrant issued under specific authority and
resolution adopted by the City Cound l of the Torn of
Fairfax, on December 2 , 1.956®

The matter of the notice to the Concrete Materials
and construction Company was defered until a later meeting
at which it was desired that all of the councilmen be
present.
It was generally agreed that the Mayor contact the

The Town clerk was instructed to consult with the
town attorney regarding a new ordinance concerning the
operation and carrying of guns, rifles, bown and arrow,
sling shots, etc.
There being no further busines6 to come before
the meeting it was moved, seconded and carried to adjourn.
