Meeting of the town council called to order at 7 ;30 P. M. by
Mayor F. .`k-eith Listebar,ger with all councilmen present.
The minutes of the preceding meeting were read and approved.
The trrasurers report, showing a balance of $13,711,61 was read
and approved.
Clerk instructed to contact Clarence Meskimen in tegard to
any passible costs to the town for crop damage in the dumping
area for this coming crop season. If no damage payment to be
made, then the clerk will notify Kenneth Buresh that his area
will not .be used this year.
Ordinance no. 27 was read. The ordinance is to regulate the parking
of vehicles on the streets in the town of -Fairfax and providing
penalties, a copy of which is hereto attached.
It was moved by Steinmetz and seconded by yanecek that the ordinance
as read be adopted. A roll call vote by the clerk with unanimous
approval was held. ...
Motion made , seconded and unanimously approved to suspend the
second and third readings of the ordinance as provided by law.
Clerk instructed to contact .Robert J. Beh to determine the length
of time needed before anyf; election could be held, considering the
period ,of time for the necessary publications. This is in regard
to the municipal water system election.
A r6soluti.on by the council to inform Ed Svoboda, representing
Ia. Elec. Lt. & Poorer Co. to proceed with the additional street
lights as :per council resolution dated Dec. 17 , 1957. If a
problem arises about placing the poles at definite 300' intervals,
then the . intersection placing should have preference.
No further business to come before the meeting., it was moved
seconded and approved to adjourn

ORDINANCE CIO.
AN ORDINANCE REGULATING THE PARKING OF VEHICLES ON THE STREETS IN
THE TOWN OF FAI FAX AND PROVIDING PENALTIES
}'e it Enacted by the Council of the Town of Fairfax, Iowa:
1 . Purpose. The purpose of this ordinance is to regulate the
parking ng of vehicles upon the streets of Fairfax, Iowa, and to provide
for the enforcement of these regulations.
Method of ar'king.
2 . Parking provisions . All vehicles shall be parked on an angle
on the east side of Vanderbilt Street from the railroad_ tracks south.
to Church Street , and on all other streets in the Town of Fairfax
all vehicles shall be parked parallel with the curb, and signs shall
be erected indicating such angle parking as provided herein.
3. Obedience to signs for angle parking. No person shall park
or stand_ a vehicle other than at an angle to the curb or edge of the
roadway on the east site of Vanderbilt Street from the railroad
tracks south to Church Street .
Penalties and Procedure on Arrest.
4. Penalty. Anyone violating any of the provisions of this
ordinance shall., upon conviction, be subject to imprisonment not
exceeding thirty days, or a .fine not exceeding one hundred dollars..
5 . Summons placed on illegally parked vehicle. Whenever any,
Otor vehicle is found parked or stopped in violation of the
restrictions imposed by this ordinances the officer finding such
'vehicle shall attach a written summons to such vehicle in a
alyloppnspicuous place and the driver of such vehicle shall be held to
app&ar at the time and place designated in the summons

6. Niotice and summons. The s,. ons shall_ be in ti>rritiug and
shall contain the registration number of the vehicle , the offense
charged, and the time when and the place where such person shall
appear.
The original copy of the su=oas shall be attached to the said
vehicle and the duplicate shall be retained by the arresting office.-
7. presumption in :reference to illegal parking® In any proceeding
charging a standing or parking violation, prima facie presumption
that the registered owner was the person who parked or placed such
vehicle at the i)oint where, and for the time during which, such
violation occurred, shall be raised by proof that:
am The particular vehicle described in the information was
parked in violation of this ordinance, and
b. The defendant named in the information. was the registered
owner at the time in question,
8. Repealer. ill ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed®
98 Saving clause. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not af'f'ect the validity of the ordinance as a
whole or any section, provision or part thereof not adjudged invalid
or unconstitutional.
10® When effective. This ordinance shall be in effect after
its final passage, approval and publication as provided by law.
