HomeMy WebLinkAbout10/28/1959 Council Minutes I I October 28, 1959 Spec meeting of the Town Council called to order by Mayor Eistebarger with all councilmen present. Because the town records were not available , the minutes and treasurers report was dispensed with. it was moved, seconded and approved that the clerk-.obtain sufficient gravel to help remedy the mud situation at the well site. It was recommended to use as little as possible to Make the task of seeding or sodding in the future easier. The, problem of disposing of the "slush" from the well driller was discussed. Realizing it is the towns responsibility to Cisdpos Knickerbocker and ask permission toe dump rthe oslush. . , gg. in the quarry area. The clerk reported that the offer that had been made to the Chicago &' Northwestern Railway at the Oct. 7 meeting had been refused. After the towns offer of Oct. 7,,-the Railway issued a license that provided for $25.00 annual payment for an indefinite period of tine . This license 'was disputed by the town attorney, and after some correspondence ! between the town attorney and the Division Engineer, the license 'provisions were revised, The new license offer provides fora single payment of $25.00 as total consideration by the Town of Fairfax to the Chicago, & Northwestern Railroad for permission to construct and maintain the .`proposed 'water laterals approximately writhin the confines !, of the south 10 , of Railroad Street. Considering that the Railroad originally asked $980,00 for a permanent easement on the same area, the town ;attorney recommended that the I license . agree.ment. as per copy attached, be approved. j It was moved . Steinmetz and seconded by Dvorak that the 1 license agreement as set forth in the copy attached between the Town of Fairfax and the Chicago & Northwestern Railway Co. be approved. '` The motioh .was unanimously approved. The clerk was instructed to consult with the Railroad company prior to final execution in regard to paragraph three of the license agreement pertaining to general taxes. There being no further business to come before this meeting, it was moved, seconded and carried to adjourn.
