It was agreed that the clerk sh�rirld contact the State Auditors 1
office in regard to an audit
the towns books.
Regis Arp had requested the .town to c.anstruct `a fence on the
north 'side .of the lagoon was decided by unanffious' Vctitent 1
to :'have. Arp construct a :simple barb wire fence (net hog
on the north side of th°e Preen and that the town would pay:
One half the expense figuring Arps labor at $1050 per hour;

reasons for the request for additional pay, bu,t the council
did not 'change its position from last months meeting. A
request for accident insurance was considered 'and the clerk
instructed to investigate what . would be available.

AGREEMENTS. The applicant agrees that the following stipulations shall govern under this permit-
L All trenches constructed longitudinally along.the road shall, be placed not closer than-1 _-______---feet
from the edge of the pavement, or not closer than from the centerline of unpaved highways.
2. The applicant will at any time subsequent to placing the cable, pipe line or the line, and at his
own expense, relay, reconstruct or encase his lines as may become necessary to conform to new grades, align-
ment or widening right-of-way, resulting from maintenance or construction operations by the Higih�way
Commission irrespective of whether or not additional right-of-way is acquired in connection with such hiigh-
way ',improvement. The applicant agrees to do this promptly on order Iby the Iowa Highway Commission, and
without cost to the State. If the applicant is unable to comply promptly, the Highway Commission may cause
the work to be done, and the applicant will pay the cost thereof upon receipt of statement.
The Iowa Highway Commission will endeavor to give the applicant sufficient notice of any proposed
construction or maintenance work, an either existing or newly acquired right-of-way, that is likely to expose,
cover up, or disturb any cable, pipe line, or tile line belonging to the applicant, in order that the appli-
cant may arrange to protect his lines. The Highway Commission willl inform contractors, and others work-
ing on the job, of the location of the lines so that reasonable care may be taken to avoid damaging the lines.
The State and the Highway Commission assume no responsibility however, for failure to give such notice.

The State and the State Highway Commission assume no responsibility for damages t '_
cant's property occasioned by any colnstruction or maintenance operations on said highway, including new or
additional right-of-way acquired in connection therewith, subsequent to the building of the said pipe line, con-
duit or the line. l
. The applicant shall take all reasonable precaution during the construction of said cable, pipe Milne,
or tulle line to protect and safeguard the (lives and property of the travelling public and adjacent prolpelrty
owners and shall save the State and the State Highway Commission halrrmless of any damage or losses that
may be sustained by the traveling publhc or adjacent property owners on account of such construction operations.
S. Operations in the construction and maintenance of said cables pipe line, or tile line shall be calrlriied
on in such a way as to not interfere with, or interrupt traffic on said highway.
& The applicant shall hold the State and the State Highway Commission harmless from any damage
that mllay result to said highway because of the construction or maintenance of said cable, pipe line, or title
line, and shall reimburse the State or the State Highway Commission for any expenditure that the State or
the State Highway Commission may have to make on said highway on account of said applicant's cables pipe
line„ or file line having been constructed thereon.
7. The applicant agrees to give the State Highway Commission forty-eight Tours' notice of its intention
to start construction on the highway right-of-way. Said notice shall be made its writing to the person whose
name is shown below.
a. Cable, pipe line and tiie line crossings shall be constructed as follows'. Water maims 2"" or Less inside diameter shall be copper, lead or
cost iron. Water mains of more than 2" inside diameter shall be cast iron and be encased. The casing shall be of adequate strength, and of suffi-
cient length to extend 2` beyond the edge of the shoulder line. Pressure sewer lines shall meet the some requirements as water mains. Gravity sewer
lines and tile lines shall be cost iron pipe or on approved extra strength pipe and need not be encased. Natural gas service lines and mains tin town
distribution systems need not be encased except as may be required of (9) below, On paved roads cables, pipe lines and casings may be placed
through the subgrode by jacking, or by boring a hale just large enough to take the line: or if the highway engineer approves, a tunnel may Ibe dug
through and the cable, pipe line or casing placed therein. On roads not paved an open trench may be dug and the cable, pipe line or the lime (placed
there�6n, and the trench backfilled over the line. All backfill of tunnels and trenches shall be thoroughly compacted in layers of B" or less in depth.
All work shall be done in a workmanlike manner, and the ground left in a neat condition satisfactory to the highway engineer in charge.
9. Pipe lines conveying gas, natural or artificial, oil, gasoline, motor fuel or other inflammable substalnces
under and across primary roads shall be installed in accord with rules of the Iowa State Commerce Commission
and American Standard Transmission and Distribution Piping System requirements.
10. This permit is subject to any laws now in effect or any law's which may be hereafter enacted.
11. This application is subject to all the rules and regulations of the State Highway Commission alnd to
revocation by the State Highway Commission at any time, when in the judgment of the Commission it is
necessary jn the improvement or maintenance of the highway or for other reasonable cause.
12. The Iowa State Highway Commission's current policy on utilities shallll apply to the work proposed in this appli-
cation,
