A special meetingof the town council was held this 18th day of
Feb. 9 1966.
Presentt Mayor Zenisek and Councilmen Buresh, Shakespeare,
Stallman and Vondrq,,. Also present were Mr. Gerholdt and
Meadows from Smith Douglas Co. and Miles Kier from the C. & N. W.
Smith Douglas requested to purchase a parcel of land from the
Town of Fairfax located at the SW corner of Tract No. 3 adjacent
to the C. & N. W, ROW and also adjacent to property owned by Iowa
Fund Inc. at the SE corner of the quart'. Price estimated by council
would be $39000,00 is same were sold.
The council agreed that this parcel could be sold contingent on the
following conditions.-
1• Approval of the P. & Z. Commission.
2, Sale must not jeopardize existing agreement with Iowq Fund.
3. Sale would not eliminate Possibility of development of
the general area by the Linn Co. Conservation Commission.
4. All proceedings must be in accordance with Code of Iowa.
5. Purchaser to provide & maintaina ccess and dustless road
at no expense to the town.
6. Purchaser must fence along North & East side of the property
wit,`-i a commercial fence,
7. Property must not become a helith hazard with regards to
sanitation. Any desired water or sewer extensions would
be at buyers expense.
81 Town would retain a 40 feet easement over sewer main on
a permanent nature.
The proposed building to be constructed by Smith Douglas would
be 1431 X 351 with 201 concrdte apron on north side and 20 tons
scale pit on northwest corner of building. Estimated value at $22,000.
The building inspector is instructed to issue a building permit for
this purpose, said permit would be limited to a building forthe
above purposes and is non transferable.
No further business, the meeting adjounned.
