Regular meeting of the Fairfax City Council was held 6/5/75
Formal letter of resignation of Harold Shakespeare as lJayor received.
James Stallman sworn in as Mayor4 Harold Shakespeare sworn in as councilmen to replace
J Stallman on council* on motion of R. Stallman 2nd R Brecht
Mayor Stallman called meeting to order, Treasures report accepted and minutes of
previous rerrular and' specialdLeetings approved.
Mr Cox and Mr Levi from la Ill Gas Co attended meeting, to hear any complaints or
suggestions from council on their service to ther City.,
Ralph's Sanitation from Amana attended meeting and presented a bid for council
consideration for garbage hauling, Tabled.

Mr Panek from Zinn County Reginal Planning staff attended meeting to preif co-.ncil
and Planning & Zoning committee on the work they are doing on our behalf in the
line of future use land planning! community detelopment, suggestions, aerial maps
etc. A. staff member will be available to help up- in these areas.

Motion of R Stallman 2nd G Stockton to allow the Fairfax American 'Legion to
transfer their beer permit to the Baseball field for the 4th. of July celebration.
Carried.
Be It Resolved by the Council of Fairfax, Iowa that the following transfer is
herby authorized: $509000 from Federal Revenue Sharing Trust Fund account to the
Recreational account for the purpose of improvements at the baseball field.
Resolution presented by R L Shakespeare with 2nd by R Stallman Carried. on the
condition that check will be held ft up until the bleachers are fixed and repair
as per instruction given ball team at special meeting, 5/19/75 and meeting is
held with St Patricks Church trusteds, ball team representatives and council
r,epresentitives#

Revenue Sharing for Fiscal Year 1975-1976 discussed, Motion of H Shakespeare
that $4*000.00 be set aside for the possible purchase of a new town truck and
that $2,410 per set aside for recreational purposes.(Tennis court). 2nd
R Stallman Carried, Clerk to publish report.
Jacques company inquired if the city had thought anything more about doing the
smoke test of the sewer lines. After a disaussio3jpatter to be tabled until the
later part of July until after the Mobile Laberator.y Program from Kirkwood Community
College evaluates, onr water and sewer dept and the men from Livingston Co are
in thun checking on the Lagoon.
No further business meeting adjourned.

CHAPTER 29
Garbage and Refuse
Be It Enacted by the Council of the City of Fairfax, Iowa.
29.01. Pur2ose. The purpose of this ordinance is to provide a sanitary
disposal project for the filial disposition of solid waste.
29 .02 . Definitions . For the purpose of this chapter, the following definitions
shall apply:
"Garbage" shall mean any and all refuse resulting from the preparation„
cooking or dispensing of food.
"Refuse" shall mean all solid waste materials from residential or
commercial premises. It shall include semi-liquid or wet wastes which
are not free flowing.

"Hazardous materials" shall include explosive materials, rags or other
waste soaked in volatile or inflammable materials, drugs, poisons, radioactive
materials, motion picture film and similar highly combustible materials,
soiled dressings, clothing, bedding and/or other wastes contaminated by
infection or contagious disease, and other materials which may present a
special hazard to collection or to the public.
"Dwelling unit"' shall mean one room, or a suite of two or more rooms,
designed for or used by one family; or a housekeeping unit for living and
sleeping purposes having only one kitchen or kitchenette.
"Can or approved container" shall mean a container for the storage
of garbage or refuse which is (a) a can with handles and tight fitting cover,
watertight, substantially made of galvanized iron or other non-rusting material
and of a size that may be conveniently handled by the collector; (b) a plastic
bag of heavy gauge plastic; (c) a commercial sized container designed for
use with a truck lift device.
"Property owner" shall mean the owner or owners as shown in the
records of the Office of the Linn County Auditor on the date the fees provided
for in Section 29.12 of this ordinance are billed.
"Person" shall mean any individual, firm, corporation or other legal
entity.
29.03. Duty to Provide Cans or Approved Containers. Each owner of
a dwelling unit shall provide cans or approved containers for the storage
of garbage and refuse accumulating on premises owned by him. Such cans
or containers shall be kept covered and reasonably clean at all times and
shall be placed on collection day at the curb fronting the dwelling or commer-
cial structure readily accessible to the collector.
29.04. Accumulation of Garbage and Refuse Prohibited. It shall be unlawful
for any person to permit to accumulate on any premises, improved or vacant,
or on any public place in the City of Fairfax, such quantitites of garbage
or refuse, either in containers or not, that shall, in the opinion of the City
Council, constitute a health or sanitation hazard or nuisance.
29.05. Storage. All garbage must be drained and all garbage and refuse
accumulating from dwellings or commercial establishments must be placed
in cans or approved containers. No garbage shall be burned. No can or
container used for the accumulation of garbage shall be used for burning
refuse.
29.06 . Collection. All garbage and refuse shall be collected from dwellings
and commercial establishments once each week. All garbage and refuse
shall be transported in a covered vehicle or covered containers constructed
to prevent spilling, draining, offensive odors, or loss of materials during
transit.
29.07. Refuse Collected. (a) The City will pick up cold ashes, cans, bottles,
magazines, papers, rags, wastepaper and yard trimmings and such other
materials as may be prescribed by the City Council; tree and shrub trimmings
not over five inches in diameter and not to exceed four feet in length and
tied in bundles; bricks, plaster, lumber or other building materials resulting
from work done by the occupants, but not more than one bushel basketful
at each pick up .
(b) The City will not pick up dead animals, animal manure, old cars
or car bodies, liquids, hazardous materials or hot ashes; logs, stumps or
branches produced from the work of commercial landscapers, tree trimmers,
or utility concerns; logs, branches or tree and shrub trimmings over five
inches in diameter or over four feet in length and not bundled; small items
in piles requiring a shovel or fork to handle; materials resulting from the
construction, repair or demolition of buildings, except as noted above;
any article more than :four feet in length, or any single article weighing
more than sixty-five pounds.

29.08 . O tional 1Ieans of Collection. The City Council by resolution may
elect one or more of the following methods to be used in collection of garbage
and refuse: (a) collect garbage and refuse with its own equipment and employees;
(b) contract with a person to collect garbage and refuse; or (c) issue a
permit to a person to collect garbage and refuse.
29.09. Necessity of a Permit. No person shall collect or dispose of garbage
or refuse, except his own, unless authorized by contract or permit with
the City.
29.100 Disposal Sites_ No person shall haul, cause to be hauled, or dispose
of any garbage, refuse or other waste material of any kind upon any land
within the corporate limits of the City of Fairfax, or within any distance
of the corporate limits of the City over which the City has legal jurisdiction,
unless such land is first approved as a waste disposal site by the City Council.
29 .11. Collection of Fees. The fees provided for in the Schedule of Fees
below shall be collected by the City every two months, or at such other times,
as may be determined by the City Council. Fees may be collected by all
available legal means and may also be secured by levy and certification by
the City Clerk to the Linn County Auditor to be collected in the same manner
and subject to the same penalties as special taxes.
29.12. Schedule of Fees. The City shall impose and collect the following
Schedule of Fees for the collection and disposal of garbage and refuse from
the owner of property which has a dwelling unit or commercial structure
thereupon. The fee unposed shall be paid by the property owner unless
otherwise agreed to be paid by the occupant of the property: (a) $ ,YO"l..

establishment.
29.13. Hazardous Materials. No person shall deposit in a garbage or refuse
container or otherwise offer for City collection as garbage, refuse or waste
any hazardous materials. Hazardous materials shall be transported by the
owner to a disposal site prescribed by the City Council.
29.14. Delinquent Fees. if any account is not paid within thirty days after
the billing date, it shall be delinquent and the City Clerk shall proceed to
collect the delinquent fees as provided in Section 29.11 of this ordinance.

29.15. Penalty. Any person violating any of the provisions of this ordinance
shall, upon conviction, be subject to imprisonment for not more than thirty
days, or a fine not exceeding $100.
29.16. Repealer. .All, ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
29.17. Effective Date This ordinance shall be in effect after its final passage,
approval and publication as provided by law.
