Purpose of meetingi informational meeting in regard to eater & Sewer rate changes,
No one attend in regard to this matter, hates will stand as passed in December, 1975.
Milo Kubasa =attend meeting to inquire about moving old motor out of Uxu Street
Building and getting rid of the extra tires. Council advised him that he should
haul old motor up to Sa .sots and that the Mayor would take care of getting rid of
the tires.
Charlie Polands liquor license approved for 1976 on motion of R. Carver
2nd R Brecht. Carried.
i ussion held on Zoning Ordinance, Clergy to get copies to P & Z so that they
have hold their hearing. A 15 day notice must be given for this hearing, They
council must also give a '15 day hearing notice before it can become final.

ORDINANCE NO.
AN ORDINANCE REPEALING SECTION 73. 08 OF THE MUNICIPAL CODE
OF FAIRFAX, IOWA, AND ENACTING NEW SECTION IN LIEL THERE F.
Be it Ordained by the Council of the City of Fairfax, Iowa, as follows-
echo 73. 08 aprove .ent , of the Municipal, Code of Fairfax, Iowa,
is hereby repealed in its entirety, and the following is substituted in lieu
thereof.
73. 08 Improvements.
1. Required. Before the final plat ziny subdivision
is approved and recorded, the owner shall sake and install
the minimum improvements described in this -section. If, at
the time of the presentation of the final plat, it is not practi-
cable or ad is Je to have the required improvements com-
pleted before the pat is accepted and approved, the o mer
shall enter into a contract with the city to make such improve-
ments at such time as may be therein stated. The performance
of the contract shall be secured by the filing of a bond approved
by the Council in an amount equal to the cost of the im-,,rove
ments as estimated by the City Engineer.
2. Water. Where the subdivision is within the city
limits, the owner shall male necess r 4,n arrangements to serve
each lot with a water main of the Fairfax ester Department
if the mains of the water department are reasonably available
in the Judgment of the Council. Such ins!tallations shall be in
accordance with the standards and specifications of the
Fairfax Water Department, and under the supervision of the
water superintendent and subject to his approval.
. �!r�ita Sewers. Where a subdivision is within the
city limits, the sa ner hall connect with the sanitary sewer
system of the city and provide adequate serer lines accessible
to service each lot if such sewer system is reasonably available
in the judgmQnt of the Council. Said sewers shall be constructed
in accordance with the standard specifications of the city under
the supervision of the City Engineer and subject to his approval.
When the subdivided lots contain an area of at least 21, 750
square feet, and public sanitary sewer outlet is not reasonably
available in the judgment of the Council, and has not been in-
stalled as here bove required, the owner shall furnish to
the City Plan Commission a report from the Board of Health
that the soil conditions of the subdivision are suitable for the
installation and maintenance of septic tanks, and that the lot
area is sufficient to provide for its operation.
4. Streets. The owner shall grade all the streets to the
required full width of the .right-of-way in,clading half streets,
alleys and other thoroughfares for public use, established in the
subdivision. The owner shall surface all streets and alleys in-
cluding half streets with one of the following types of surfacing-
a. Reinforced concrete pavement with integral curb
and gutter as specified in the standard city speci-
_71cations.
b. Asphaltic concrete pavement with a reinforced con-
crete curb and in accordance wi:t.h specificatiins
of the City Engineer.
Where .-ne-half width streets adjacent to one-half
width streets previously dedicated for public use,
the owner is not required to construct and pay for
a full width pavement but unless otherwise arranged
for he is required to file a petition with the Council
requesting the streets to be paved under public
contract, the costs of which will be assessed to
the benefited property. In such petition the owner
shall a,,,,:,free to pay the full cost of that portion of
the irnprovement as may be assessed against his
abutting property under the laws of Iowa, and shall
further agree and consent to waive his rights under
Section 391 , 48, of the Code of to a4

5. Street Tid-VIties and GLa��ja Before the construction
of pavement, the required utilities such as water, se,:�,er, gas
and other utilities shall be installed along with connections laid
to a point in the street not more than 8 feet from the property
line. All trenching backfill shall be compacted in accordance
with city specifications and the sub-grade made acceptable for
street surfacing.
The width of the street surfacing shall conform, to the
traffic r*-quirementa of the street and shall in no event be less
than 28 fec," in width including curbs.
In case of half width streets bounding, the plat the owner
is required to construct only one-half of the width of an all-
weather street surface, if in the judgment of the Council such
surfacing is necessary.
All street grading and street improvements shall conform
to the appropriate standard plans and specifications of the city,
6. Drainages Adequate provisions shall be made for
drainage of surface water subject to the approval of the City
Engineer,
7. Grad�g_Lots, The owner shall., whenever necessary,
grade any or all portions of the property subdivided with lots so
that each lot will be suitable and usable for the erection of res.1-
dential or other structures thereon,
8. Utilities. The City Plan Cor:-.-,mision, and the Council,
may require ',R'o_,t such improvements as electric lines, gas mains
and sirnil%r facilities in any subdivision shall be arranged for
,�jhere necessary before the plat is approved.
9. SidewalkE. Sidewalks shall be constructed on both sides
of the street .n. the subdivision, including replats, and shall be
no less than 4 feet in width and no less than 4 inches in thick-
ness and shall be constructed in accordance with plans and spec. -,
fications approved by the City Engineer, except, the owner n-,-ay
be granted per: fission by the Council to onift a sidewalk or side-
walks to a subdivision or any part thereof if M* the discretion off

10. Maintenance EonA. Any person desiring to engage
in the cons,.-Vuction of the improvements described in Sec-
tions 73, 08(2), 73. 08(3) and 71S. 08(4) above., shall execute a
Maintenance Bond in a form and amount approved by the
Fairfax City Council.
