Since this area is within 2 miles of the Fairfax City limits the approval of

A,N ORDINANCE REPLALIING' ChArTER 61 OF THE MUNICIPAL CODE OF
FAIRFAX, IOWA, AND ENACTING A NEW SECTION IN LIEU THEREOF.
Be It Ordained by the Council of the City of Fairfax, Iowa, as follows,
g1l�ter 6 1 . Licejjsjn _end Control of_22_es, of the 1-dunicipal Code of
Fairfax, Iowa, is hereby repealed in its entirety, and the following is substi-
tuted in lieu thereof.
CUAPTER 61, LICENSING A1144 CONT-FLOL OF DOGS.
61,01 DEFINITION SP Terms used in this chapter have
the following meanings.
Dog: Includes both rnale axis female animals of the canine
species.
Owner: Any person owning, keeping or harboring a
dog.
1�enaaj do S og8 kept or raised solely for the purpose
of sale and kept, under constant restraint.
Veterinary hospital, A public establishment regularly
maintained and operated by a licensed veterinarian for the diagnosis
and treatment of diseased and injured animals.
At large; Off the premises of the owner, -unless with
reference to a dog it is,
1 . Attached to a leash of sufficient strengtb to restrain
the dog. and not more than six (6) feet in length, when the leash
is held by a person capable of restraining and controlling the
dog, or

2 a Properly restrained within a motor vehicle or housed
in a veterinary hospital, or
3. Accompanied by mad at "bee!" beside the owner
or other person.
61.02 DOG LICENSE.. The owner of any dog over three
( ) wonth5 of age .dept in the city shall on or before April 1
of each year obtain a license for such dog from the City Clerk
of Fairfax, Iowa. Dogs whose owners are nonresidents tern- orarily
itiAn the City for a period of leas than thirty (30) days, or
dogs brought into the City for the purpose of participating in
any dog show or "wean eye" dog s trained, to assist blind persons
for the purpose of aiding them in going from place to place,
or kennel dogs need zct be licen sea. Any owner~ who becomes
a resident of tine amity after April 1 of any year shall obtain a
license for his doh. within ten (10) days after becoming a resident
of the City. Any person owning a dog which becomes three
(3) months of age after April 1 of any year shall obtain a license
for such dog within ten. (10) days after the dog becomes three
(3) Months of age.

61.03 LIB Tai FEE. A dogg license shall be issued by
the City Clerk of'Fairfax, Iowa, upon payment of an annual
license fee m The license fee for a Lriale dog or a spayed female
dog shall be Two Dollars ( 2) and for a female dog Five Dollars
( 5) . The owner shall state at the time application is made
for such license, upon printed forms provided, his name and
address, and the breed, color and sex of the dog. Any owner
who tides not obtain an animal license for such dog prior to
April 1 when required so to do under this chapter shall pay
a 'two Dollar 2) penalty in addition to thelicense fee for such
year. No license fee shall be refunded.
61.04 DOG AG COLLAR. Upon payment of the
license fee the City Clerk of Fairfax, Iowa, shall issue to the
owner a. license and a tag for the dog licensed. The owner
shall provide his dog with a collar to which the tag must be
securely fixed at all tires. In the event a doh tai; is lost or

destroyed a duplicate will be issued by the City Clerk of Fairfax,
Iowa, ixpon the presentation of a receipt showing payment of
the license fee for the current year and by payment of fifty cent

61.06 USE, OF ANUIVIAL s No person shall torment,
deprive of necesaary sustenance, k.a tilate, over-load, cruelly
twat or kill any aninial, or unnecessarily fail to provide it with
food, drink, shelter, or protection from the weather, or come it
any other act or oraission by which unjustifiable pairk or suffering
is caused to any aria aL
61.07 RUNN'ING AT LARGIE PROHIBITED I a It shall be
unlawful for any dog, whether licensed or unlicensed to run
at large as def"iried in this chapter, a d. any dog so running
at large shall subject its owner to the penalties provided for
a violation of the .Fairfax i0unicijpal Code
61.08 LYIPOUNDING DDS 4 All dogs found running at
large shall be impounded by the person or agency aut on ed
by the 1,aizfax City, Council.
6L09 NOTICL TO OWNER AND REDEMPTION, Not later
than three (3) days after the llnpoun$ding of any dog, the owner,
if known, ahall, be notified of such impounding. The owner
of any dog impounded may reclahn such dog . pax the payment
of the license few, if unpaid, and by payi ent of all costs and
charges incurred by the City or t:ie agency authorized to impound
dogs, including h � � h.

if the owner is unkn o n, three (3) days after the impoundment
of the dog, the owner has failed to clam and redeem any impound-
ed dog, the clog, may be humanely destroyed, any dog wbich
appears to be suffering from rabies Sri:en impounded shall be
confined in tie pound or a ve-teri nary hospit l for a perlod of
of less thRn fourteen (14) days w-id the dog, or its carcass
if it dies, shall be subject to such medical r pathological teats
as the County Health Officer shall recommend. The tests shall

Be It Ordained by the Council of the City of Fairfax, Iowa, as follows:
Section 50. 15 Through Highways, of the Municipal Code of Fairfax,
Iowa, is hereby repealed in its entirety, and the following is substituted in
lieu thereof:
