Carver, K Janke, � V Cep y present inutes of previous eetin approved. Minutes of P Z meting held 2/1/78 were read by Mayor Stall-man. They showed that 3 rezoning petitions had been presented to them. R foods frow RR1 to C-2 , Xichael Hickey from R1 to 0-2 and K Selzer froN R1 to R-3. Recommon dation to approve Fickey's p ition carried on unanimous vote. No re4ommondation tent to Counei1 on Woods petition as it died for a lack of notion, Recommondation to approve Selzer's petition on a 2' yes, 1 no and 2 abstain vcate® Leroy Paersan was elected new chairman of P & Z Public hearing opened on rezoning petitions. Kern Selz,er's from .Rl to R3 was bandl_ei fist. A petition from 1 signers the area against the rezoning was presented as were letters from Connie Barta, Rey Marta. and Orville Smtth protesting the ehan e. A petition witb 172 signatures for the rezoning were presented as well as a letter from D. C. Neuhaus favorinr the change. Discussion held on the appointment of someone to fill the vacancy on the council because Raymond Pr°eebt did no accept the position he was elected to as a write-in at the election in November. T,eroy Patterson was nominated. to fill the vacancy on the motion of R Garver 2nd F Hanke. Carried. Mr Patterson was sworn in by City clerk and. took his seat at the council table. TO THE MAYOR AND COUNCIL OF FAIRFAX, 10WA: For approximately the last 7 months, I have attended numerous meetings for the purpose of trying to protect my property from -being devaluated by building apartments directly across the street from me. This question is getting awfully close to harassment. Webster's definition of harassment is: 1 ) to worry or torment, 2) to trouble by constant attacks. I understand a oerson can ask for rezoning of' a piece of property. I also think there should be some ordinance pertaining to the .amounu of -times this can be done as it creates hardships on everyone involved. It costs the people involved time away from home and jobs. it costs the torn nionev 'Do publish all the notices in the newspapers. also believe the council was elected under a democracy by the majority of voters. I think we all live and believe in democracy, therefore, I will quote Webster in the definition of Democracy: (The people to rule) - 1 ) Government by the people, directly or through representatives, 2) a country with such government. 3) equality of rights, opportunity and treatment. I don't remember how, many times the property owners directly involved in this dispute have asked both the planning and zoning and the council to say no to the request by Ken Selzer. I am now asking the council to once again say no to this request. I also would like to ask the council to act upon the zoning request made by Mr. Jacobek. This would not allow anyone to petition for rezoning over once in a year for the same piece of property. Some of my reasons for asking the council to say no are: 1 . Noise 2, Traffic 3. Water and Sewer 4. Streets 5. Apartments do not blend in with the houses now in the area. My home lays north and south. Russ Carver' s north 2 south, I understand the apartments will lay East and West. There is no wa y this will bl end i n with the present homes. I am sorry I can't attend the council meeting due to the fact I have an Income Tax Appointment. I therefore, ask the council to act on this in a democratic way. You were all elected to represent. the citizens of Fairfax. Under a democracy you are a form of Government elected by a majority to serve in their best interests. I again ask you to vote with the majority of property owners in the affected area and say no to the rezoning request by Ken Selzer. I realize that some of the council members are sick of hearing our objections to this rezoning, but they are no sicker of listening to us than vie are of listening to Ken Selzer and all of his reasons for wanting ape{-tnn�ents. I think this would be the appropriate time for the council to enact'- some ordinances to limit the Limes for rezoning and at the same time say no to January 31 , 1978 I spot zoning.
