Virginia inia oukup, City Clerk Tames stallman, Mayor AGREEMENT This -Agreement made and entered into on this f 'Y `+ day of 1980, by and between David Barker, d/b/a Barker's Sanitation (hereafter referred to as "Barker") and the City of Fairfax, Towa (hereafter referred to as "Fairfax") . Barker and Fairfax, in consideration of the mutual promises, benefits , j covenants and obligations herein made, agree as follows: 1. Barker shall operate a trash and garbage pickup and hauling service in the City of Fairfax, Linn County, Iowa, for a period of one 1 ear, commencin g L, and ending cf r� 2. Barker shall pick up trash and garbage within Fairfax on Friday of each week at all residences, busine.sscs and commercial establishments, nonprofit organizations, City offices and services and the City I'ar.k, when in use, and deliver said trash and garbage to the Cedar Rapids Landfill for disposal. If Friday falls on a legal holiday, then the pickup shall be on the following day. ' 3. Fairfax shall require that its residents place trash and -garbage at the curbs in front of their respective dwelling places and businesses, and Fairfax shall make every reasonable effort to keep the streets clear to facilitate the garbage and trash pickup. 4. All garbage shall be wrapped in newspaper or other similar material end placed in a container. Containers shall be the regular metal or plastic types which have handles and tapered sides along with proper fitting lids. Plastic bags designed for this purpose are accept- able. No containers shall weigh more than sixty (60) pounds. Large items of junk or trash will be collected through private agreements with the landowner, except that Christmas trees will be picked up at no extra charge. Trash, including fall garden cleanup and spring cleaning, will be picked up as long as the items are reduced to packages weighing less than sixty (60) pounds. Brush may be placed for collection as long as the bundles are securely tied and not in excess of four feet Long and not exceeding sixty (60) pounds in weight. 5. Barker shall use packer trucks in the collection of trash and garbage. 6. Barker shall hold harmless and indemnify Fairfax from all ti;ibil:ity, claims, damages and court costs, including attorney fees, for injury or death to persons or damage to property in Lrny manner c.cittsLd by, arising front, incident to or connected with the work to be performed by Barker pursuant to this Agreement. Barker shall carry liability insurance in the amount of Three Hundred Thousand Dollars ($300,000) personal injury and One Hundred Thousand Dollars ($100,000) property damage, naming Fairfax as an additional insured, and provide Fairfax with evidence thereof. 7. Fairfax shall pay Barker the amount of Three and 50/100 Dollars ($3.50) per month per pickup. In the event the. price of gasoline increases five cents ($.05) pier gallon from the price of per gallon, the charge per pickup shall increase four cents ($.04) per month. The number of pickups shall be determined by the utility records maintained by the Fairfax City Clerk for residences, businesses and commercial establishments, non-profit orgainzations, City offices and services and the Cityh park. 8. Fairfax has entered into an agreement to allow Barker to dispose of trash and garbage at the Cedar Rapids Landfill and shall pay the fee charged by such disposal site for dumping the trash and garbage collected pursuant to this Agreement, and the terms and conditions of said agreement are incorporated by reference and made a part of this Agreement as if fully set forth herein. y. Barker shall keep accurate records of all trash and garbage waste being collected and hauled to the Cedar Rapids Landfill and shall submit a monthly report thereof to Fairfax. If required by the Cedar Rapids Landfill, :Barker shall provide the Cedar Rapids Landfill with a list of Barker's customers. 10. This Agreement shall be automatically renewed on a yearly basis unless terminated by either party giving written notice to the other party of not less than thirty (30) nor more than ninety (90) days � �, . prior to the clay of .�l � f 1981.
