Regular meeting of the Fairfax City Council was held 7/1/&2. Mayor James
Stallman presiding. Council paeesent Carver,Cerveny, eight , Josifek,
Shakespeare, 25 citizens attend meeting,
Minutes of previous meeting approved and placed on file.
Clerks report received and placed on file. Receipts to be credited for
the month of Tame. General $9,905.28, Rev®Sharing 60087, R1iT 1178.508 Debt

Linn County Sheriffs contract for F°/Y 82/83 signed on motion of

Public hearing opened at 7.°15 PM. on Rezoning petitions. 1 Verbal-objection,
to the rezoning of 542 Williams Blvd and a,pet,ition signed by 19 objectors
to the rezoning of 518 Vanderbilt Street.

RESOLUTION NO. 718-,
WHEREAS, the City of Fairfax, Iowa, desires to submit a proposed
Ordinance to the electors of the City of Fairfax, Iowa, for considera-
tion. The Ordinance, if approved, would grant Starwest, Inc. , the non-
exclusive right and authority to construct, operate, maintain, repair,
replace, renew, reconstruct and remove a cable television system across
public property in the city limits of the City of Fairfax, Iowa. The
proposed Ordinance is attached hereto.
NOW, THEREFORE,, BE IT RESOLVED by the City Council of Fairfax,
Iowa, as follows: 'The attached Ordinance shall be submitted to the
electors of the City of Fairfax, Iowa, at an election to be held at the
City Hall, Fairfax,, Linn County, Iowa, on a date to be set, at which
time the polls for voting shall be open from 7 A.M. to 8 P.M.

The meeting of the Fairfax Planning and Zoning was
called to order by chairman Gordon Sorg, with all
members present® The minutes of the previous meeting
were read and approved. 17 area residents were in
attendance.
the first item on the agenda was Charlie Boland - Ken
Selzer, change of zoning from Rm1 Resedential to R--
Multi - Housing, on part of N�iti� ME' Sec. 16®82- W5, Linn
Co. Lot 19 Irregular Survey. Commencing at a point 150' S
of the Tntersection of S Line of Church St. and East Line
of Varderbilt St. run&n;g Fast parallel with said Church
St. 150' : Thence South 112 feet; thence West 150 4 thence
North 112' to 'lace of beginning. Ken plans to build
Multi Housing consisting of 4 - 2 bedroom and 4 - IL bedrsam
apartments. Dick Zeri.sek presented a signed petition from are::
residents opposing the purposed rezoning. Dean Hartman
then said he thought it unwise to make anymore scoot changes
in zoning without a plan for further coning changes.
Dick Hanover made a motion seconded by Gary Sto kton
that we vote of) the change. With 4 no votes motion failed.
Nark Neuhaus there presented his rezoning request for a
change from. 01 to C-2 an Lot 3 of the NQ NE' Sec. 16-82-8
to open Ad repair shoe in his garage. Edna DeLaney then
asked if it could be a temporary rezoning which when
sold by Mark would change bac k to R®1. But she said she
no objections to the zoning change. Bob Erger made a
motion, seconded by Leroy Patterson that the rezoning
be approved. 3 yeses , 2 no , labstain. Passed.
A further business Leroy Atterson made a motion.

Commencing at a point 150' S of the Intersection of S Line of
Church St. and East Line of Vanderbilt St. , running East parallel
with said Church St. 150' : Thence South 112 feet; thence West 150
feet; thence North 1.12 feet to place of beginning.
